Yamashiro per Communication No. 429, dated August 26, 1999, regarding the change of zone request by Ruth W. Ward, at Waiakahiula, Puna, Hawaii, TMK: 1-5-6:23, reports as follows: Bill No. 125 amends Section 25-8-26 (Pahoa Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 23,196 square feet of land from an Agricultural (A-la) to a Village Commercial (CV-10) zoned district. The somewhat quadrangular shaped, level subject parcel, owned in fee by the applicant and Elbio R. Calace, who has granted permission to the applicant to apply for the permits, is located on the east side of Pahoa town directly across Pahoa High School. The applicant would like to convert the existing vacant single-family dwelling on the site into an office building. Tentative office uses include real estate, physical therapy or other outpatient medical related services, insurance, photography studio, and other similar uses. An on-site parking to accommodate a minimum of 6 vehicles would be provided. Upon receipt of all necessary approvals, the applicant intends to proceed with the conversion, and hopes to obtain a certificate of occupancy prior to the end of this year. The existing 600-square foot storage and carport building will be removed. The current State Land Use designation is Agricultural. The General Plan LUPAG Map designation is Medium Density Urban which includes village and neighborhood commercial and residential and related functions, so the CV-10 zoning would be consistent with this designation. The County Zoning is Agricultural 1-acre. The subject property is not situated within the SMA. The USDA Natural Resources Conservation Service's Soil Survey Report designates the soils as Olaa extremely stony silty clay loam with rapid permeability, slow runoff and slight erosion hazard. This soil is used for sugarcane. The Land Study Bureau's Detailed Land Classification System designates the soils as "D" or Poor. The Agricultural Lands of Importance to the State of Hawaii (ALISH) designation is Unclassified. PC-58 PC-58 Page 2 September 21, 1999 The subject property is located in Zone "X", which is an area outside the 500-year flood plain. It is unlikely that any archaeological features and endangered plants or animal species exist on the property since the property has been developed. Surrounding lands are zoned A-la and RS-]0 and are mostly in residential uses. Adjacent to the subject property on the Kapoho side is a single family dwelling. Adjacent to the property on the Pahoa side is a vacant pazcel. The Pahoa High and Elementary School is directly across the property and the Kamehameha School/Bishop Estate pre-school is located less than 100 yards from the subject property. A church, automotive repair shop, and service station aze located less than 250 yazds from the property on lands zoned CV-10. Access to the subject property is from Pahoa Road, a County road with a pavement width of approximately 25 feet, and right-of--way width of approximately 35 feet. The applicant intends to extend the existing pavement and improve that portion of the shoulder fronting the subject site with asphalt pavement and a rolled curb, to allow for additional pedestrian safety. The Department of Public Works requests the continuation of the road right-of--way widening of approximately 14 feet, and suggests the applicant provide roadway improvements along the entire frontage and dedicate the improvements and widening to the County. The Department of Public Works notes that the commercial standard roadway consists of a 42-foot wide pavement with concrete curbs, gutters and sidewalks, within a 60-foot right-of--way. Water can be made available from an existing 8-inch waterline along the Keaau-Pahoa Road fronting the property, with a connection size subject to review and approval during the construction design phase of the proposed development. The applicant notes that the improvement of the proposed pazking could increase surface runoff. In that event, a drywell or another appropriate drainage control system consistent with the Department of Public Works' requirements will be installed by the applicant. The existing cesspool would continue to service the structure, however, should this be insufficient to accommodate the commercial office use of the site, a septic system would be installed. Electricity and telephone aze available to the site. Your Committee did not entertain any discussion on this measure. PC-58 PC-58 Page 3 September 21, 1999 Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the change of zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 125, and recommends it pass first reading.
