STATE OF HAWAII <br /> • ',TE'Gi•NP�- <br /> RESOLUTION NO. 245 12 <br /> RESOLUTION ACCEPTING THE GRANT OF EASEMENT FROM AKEBONO TOWN CENTER, <br /> LLC FOR STREET LIGHT POLE PURPOSES. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, AKEBONO TOWN CENTER, LLC is the owner of Tax Map <br /> Key: (3) 1-5-002:026, situated in Pahoa Town, Waiakahiula, District of Puna, Island, County and <br /> State of Hawai`i; and <br /> WHEREAS, the County of Hawai`i would like to install a street light on utility pole #2 <br /> adjacent to Luquin's Mexican Restaurant to illuminate the raised crosswalk; and <br /> WHEREAS, Akebono Town Center, LLC is desirous of granting the County of Hawai`i an <br /> easement, which easement is more particularly delineated on Exhibit "A" attached hereto; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the <br /> Council, on behalf of the County of Hawaii, may accept gifts or donations of money, securities or <br /> other personal property or of real estate or any interest in real estate. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I, in accordance <br /> with Article XIII, Section 13-12 of the Hawai`i County Charter, the County of Hawai`i accepts the <br /> grant of easement delineated on Exhibit"A" attached hereto, from Akebono Town Center, LLC. <br /> BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor <br /> William P. Kenoi; (2) Director of Department of Public Works Warren H. W. Lee; (3) Deputy <br />
