RESOLUTION NO. 245 12
RESOLUTION ACCEPTING THE GRANT OF EASEMENT FROM AKEBONO TOWN CENTER,
LLC FOR STREET LIGHT POLE PURPOSES.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, AKEBONO TOWN CENTER, LLC is the owner of Tax Map
Key: (3) 1-5-002:026, situated in Pahoa Town, Waiakahiula, District of Puna, Island, County and
State of Hawai`i; and
WHEREAS, the County of Hawai`i would like to install a street light on utility pole #2
adjacent to Luquin's Mexican Restaurant to illuminate the raised crosswalk; and
WHEREAS, Akebono Town Center, LLC is desirous of granting the County of Hawai`i an
easement, which easement is more particularly delineated on Exhibit "A" attached hereto; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the
Council, on behalf of the County of Hawaii, may accept gifts or donations of money, securities or
other personal property or of real estate or any interest in real estate.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I, in accordance
with Article XIII, Section 13-12 of the Hawai`i County Charter, the County of Hawai`i accepts the
grant of easement delineated on Exhibit"A" attached hereto, from Akebono Town Center, LLC.
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor
William P. Kenoi; (2) Director of Department of Public Works Warren H. W. Lee; (3) Deputy
Corporation Counsel William V. Brilhante; and (4) Salvador Luquin Jimeniz, owner of Akebono
Town Center, LLC, P.O. Box 873, Pahoa, Hawai`i 96778.
