Amendment to Chapter 9 (Subdivision Code)

The Planning Commission after a duly held public hearing on
August 22, 1974 voted to recommend for your approval the at-
tached proposed legislative bill based on the following con-
siderations:
The subdivision of lots for public utility and/or public rights -
of way are done in the interest of the public welfare. The pro-
posed public improvement projects which affect the subdivision
of land would comply with and implement the respective elements
(Public utilities/public facilities, transportation, etc.) of
the General Plan. In essence, these proposed public improvement
projects which require subdivision seek to improve and provide
new systems are in the best interest of the general public.
Normally, funds for public improvement projects have been appro-
priated by the respective legislative bodies (County, State,
Federal) through the Capital Improvements Program. Before any
of these Capital Improvements Projects can be appropriated, they
would have to complement and conform to the General Plan document.
The lots on which proposed public improvements are to be pro-
vided need not require ample space in terms of lot area. A mini-
mum amount of area is usually sufficient to provide and/or con-
struct the proposed public improvements. These types of subdi-
vision and their proposed uses are vitally necessary to provide
efficient services to the general public and would not be ma-
terially detrimental to surrounding properties in the immediate
vicinity.

In regards to the matter of the filing fee, the Commission felt
that it is only proper that a portion of the fee be refunded to
the applicant should the subdivision request be withdrawn or
denied before tentative subdivision approval is granted. It is
felt that it would be unfair to assess an individual who has
withdrawn or was denied his application the same amount as an
individual who has obtained approval of his subdivision request.
