The Planning Commission after a duly held public hearing on
August 22, 1974 voted to recommend for your approval the at-
tached proposed legislative bill based on the following con-
siderations:
Under the present regulations, cemeteries cannot be located on
lands which are not owned in fee simple. Since many of the
County's lands are not considered to be owned in fee as they
are transferred to the County under the authority of an Execu-
tive Order by the State of Hawaii, the present Section of the
Code would preclude the County from establishing, enlarging,
or extending cemeteries on these lands.
In essence, the proposed amendment would exempt lands which
are transferred to the County under the authority of an Exe-
cutive Order by the State of Hawaii. Therefore, this amendment
would enable the County of Hawaii to establish cemeteries on
lands which are transferred to the County under the authority
of an Executive Order by the State of Hawaii.
