Re: Proposed Bill - Amendments to Variance Procedure
The Planning Commission, after a duly held public hearing on
March 14, 1974, voted to recommend for your approval of the above
proposed legislative bill based on the following considerations:
1. That the proposed amendments would be basically consistent
with the provisions of the Planning Commission's rules and
regulations which were adopted pursuant to the County Charter.
The Zoning Ordinance was effective prior to the adoption of
the County Charter and ensuant rules and regulations. Accord-
ingly, there are some inherent inconsistencies between the
Zoning Code and the Commission's rules and regulations. This
proposed amendment is designed to eliminate such inconsisten-
cies; and
2. That the review/action and appellate periods were too brief
and are consequently, proposed to be extended. The Zoning
Code provides a maximum of forty-five (45) days for the Com-
mission to hold a public hearing and render a decision.
Because of the Commission's schedule, it sometimes becomes
impossible to hold a public hearing within forty-five (45)
days. The Commission normally meets once a month or at least
three times in two months. Additionally, there is a pre -
hearing requirement before a public hearing is scheduled for
any application. Thus, a minimum of two meetings are involved
to satisfy the prehearing and public hearing requirement. The
forty-five day period is obviously much too short, and accord-
ingly, it is proposed that that period be expanded to sixty
(60) days.

Re: Bill No. 38 - Amendments to Variance Procedure
It was recently brought to our attention that Section 8 makes
an erroneous reference to "Supervisors." In checking with
the County Code, we note that the term has already been
amended to read "Council." Thus, the corrected amendment
should read as follows:
"SECTION 8. Section 7.05 is hereby amended by
substituting the word and numbers 'thirty (30)' for
'fifteen (15)' and substituting the word 'appeals'
for the word 'Council."'
