Dear Mr. Luer
The reason I an writing to you today is to request a clarification
on the matter of a quorum on commission meatings. I are specifically
referring to the meeting hold in Kona by our Pla=ting Omission on
Wednesday, February Zai, 1974.
1 believe that under the teras of our Charter, the action of the
Planning Counission was inherently illegal because of the lack of din
process in carrying out the roccomeadatwa.
I refer You in this regard to the County Charter which provides
that the Planning COMISsiOR shall consist of niso maw�ers. I further
D refer you to the provision of the Charter which states that In the event
of a vacancy on any cemaissTos, that 'eraraMy shall be filled. It is my
understanding that a quorum woald repiro a majority of the aeemders of
any coameTssian to be present to wrote on any item which is on the agenda.
Ny belief is that the required qgorga under the term of the County
Charter would bre a minUmm of fits persons present quad Ming on any issue
before the Planning Coma"6190. You, will note that insofar as the VMW
meeting thare wars only four members, of tiro coaraission present.
Any other interpretation of tba Charter would amm that In the event
all but one of the members of the Planning Commission were terminated by
virtue of death or expiration of their two, one man could wage all of the
docTsioaes as lea$ as he was present at the meeting. this is obviorsly
not the Tartest of the letter of tho law Insofar as our County Charter is
concerned.
I request yew 10004fate attention to this matter in the interest of
trying to W"Stata some sort of legal semblance in the political meciesmm.
