Pursuant to Hawaii County Code (HCC) Sec. 3-22(a), I am forwarding The Goodyear
Tire & Rubber Company's completed application for a sign variance. The owner of the
property is Queen Lili'uokalani Trust Estate/ Pit Leasing, LLC and the applicant is Chad
Raymond of John Allen Sign Company whose phone number is (808) 882-8244. The
applicant is requesting a sign variance for a wall sign. The proposed sign is 81sf. in area
with 22 inch high lettering and a 36 inch symbol mounted at 14 feet above finish grade.
The maximum allowable area is 75sf per section 3-58 (a)(5)(C) chapter 3, Hawaii
County Code. The maximum allowable letter and/or symbol is eighteen inches per
section 3-58 (c)(1) chapter 3, Hawaii County Code. The business is located in MG-la
zone which limits the wall sign to nine feet in height per section 3-59(a)(4) chapter 3,
Hawaii County Code.

(a) Granting the variance is necessitated by the peculiar physical conditions not ordinarily
found in most districts,because of the peculiarity of a business,or as a result of a special
event or circumstance;
(b) Granting the variance will not adversely affect the rights of adjacent property owners or
tenants;

(c) Granting the variance will not unreasonably violate the interest, safety, convenience,or
general welfare of the public;
(d) A strict application of the terms of this chapter would work unnecessary hardship and
practical difficulty upon the applicant or community;
(e) Granting the variance will not constitute a grant of personal or special privilege
inconsistent with the limitations upon other properties under identical ordinances, statutes
or rules.

Explanation of circumstances which necessitate a sign variance be granted for TMK(3)7-4-015:010
"The Goodyear Tire and Rubber Company dba Goodyear Auto Service Center (Goodyear) is applying
for a variance to the sign code. Goodyear wishes to install a wall sign as per the specifications provided
on the sign permit application. The total area of this sign is 81 square feet whereas the sign code
specifies a maximum sign area of 75 square feet for wall signs. The proposed sign is to be 6 square feet
larger than the maximum size allowed by the County of Hawai'i signage guidelines for the Kailua
Village industrial Subdivision. Goodyear feels that the larger size sign is necessary because the
proposer sign to be located on their storefront wall is their main point of identification and
adverbs __gent for vehicular traffic along Kaiwi Street.As with every business along Kaiwi street,
Goodyear relies heavily on this vehicular traffic to attract customers. The larger sign will not violate the
interest. safety, convenience or general welfare of the public because it will be built and installed to
sign in: .ry standards with regards to quality and durability. In particular we feel that the convenience
of the p-.7_13 will be enhanced by the larger sign on Goodyear's storefront. It is for this reason also that
the rig__ s 31'the adjacent property owners will not be adversely affected, indeed it may actually benefit
other'b.r.s_nesses in the area to have more potential customers being drawn to the area.A strict
enforcers of the sign code in this case diminish Goodyear's capacity to advertise themselves as
servic.° ;\iders to the growing community of Kailua-Kona."

SUBJECT: Kailua Village Design Commission Meeting of March 20, 2012
Applicant: Goodyear Auto Service Center No. 8021
Land Owner: Queen Lili`uokalani Trust
Design Review of a proposed Wall Sign for Goodyear Auto Service Center
(Sign Variance Application)
Tax Map Key: 7-4-015:010 (COR-12-077228)
This letter is to inform you that the Kailua Village Design Commission, at its March 20, 2012
meeting, voted to recommend to the Public Works Director his conditional approval of the
above-referenced sign variance application which would allow 22" high lettering, a 36" high
logo and a mounting height of approximately 14 feet above finish grade.
The Commission recommends that approval of the requested sign variance be subject to the
condition that there be no other signs or banners of any type permitted or displayed for this
business on this parcel of land, other than the one sign described in the variance application.
The Commission stated the following reasons for its recommendation of conditional approval:
1. The sign area is less than 15% of the area of the wall on which it is to be mounted and is
of reasonable proportion and harmony with the architecture of the building;
2. The sign is to be substantially setback from Kaiwi Street, at approximately 35 feet from
the street front property line, and beyond which there are no pedestrian walkways and
virtually all customer traffic is vehicular, from 10 to 20 feet further removed;
3. The proposed mounting height is appropriate for vehicle-based visibility above storefront
parking and required ADA accessible parking sign heights.
4. The applicant has numerous seemingly impermissible banner, window, wall and other
signs on the subject property (see Attachment A).

Accordingly, the Commission determined that an express limitation of signage to the applicant's
one requested over-sized sign is a reasonable requirement for its approval, and would also
represent the Commission's sentiments as to the importance of compliance with the signage
limitations set forth in the Sign Code for the Kailua Village Special Design District.
