Your Committee on Planning, to which was referred Comm. No. 671/Bill No. 231, reports as
follows:
Bill No. 231, transmitted by Mayor William P. Kenoi, via Communication No. 671, dated
April 11, 2012, is a Planning Director initiated ordinance amending Chapter 25, Article 2,
Division 4 and Article 6, Divisions 4 and 5 of the Hawai`i County Code 1983 (2005 Edition, as
amended), relating to notification requirements for Zoning amendment, Project District and
Agricultural Project District Applications. Also enclosed was a favorable recommendation from
the Windward Planning Commission Chair Zendo Kern and Leeward Planning Commission
Chair Geraldine Giffin.
Deputy Corporation Counsel Amy Self and Planner IV Maija Cottle were present in Hilo.
Ms. Cottle stated that this bill was a housekeeping measure to fix the language in the Zoning
Code relating to notification requirements for zoning amendment, project district and agricultural
project district applications. She also added that it would clean up the Code and make it
consistent with the change the County Council made in 2010.
Council Member Ford asked for clarification on what"acknowledged receipt" means in regards
to the number of days allowed to process an application. Ms. Cottle replied that Planning has ten
days to either reject or accept the application.
Your Committee on Planning is in accord with the purpose and intent of Bill 231, and
recommends its passage on first reading.
