HomeMy WebLinkAboutORD 2012-053 2010-2012COUNTY OF HAWAII STATE OF HAWAII BILL NO. 190 ORDINANCE NO. 12 53 AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 8, DIVISION 1 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PARKING REGULATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`L• SECTION 1. This measure was generated to allow for the expeditious loading and unloading of passengers in designated loading and unloading zones intended for in tow or tow -away zones. SECTION 2. Chapter 24, Article 8, Division 1, Section 24-202.1, Parking prohibited in tow or tow -away zones, paragraph (a), Hawai'i County Code 1983 (2005 edition, as amended), is amended to read as follows: (a) When official signs are erected designating a street or portion thereof as a tow or tow - away zone, no person shall stop, stand or park a vehicle, even momentarily, between the hours indicated on such sign; provided, however, that stops may be made for the expeditious loading or unloading of freight and passengers in official loading and unloading zones; and provided, further, that buses may stop for the expeditious loading and unloading of passengers in official bus stops. In no case shall the stop for the loading or unloading of freight [exceed thifta for- the leading and u nlea ing e and passengers exceed [threeminutes] the time as established by the pertinent zones. Provided, however, that when reauested for noncommercial or nonbusiness purposes only, the County council may by resolution suspend for a period of not more than one week any parking prohibition herein provided. SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
