Re: Res. 270-12; Comm. 752; Waived FC (2010-2012 term) COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 270 12 A RESOLUTION REQUESTING THE OFFICE OF THE LEGISLATIVE AUDITOR TO CONDUCT A PERFORMANCE AND FINANCIAL AUDIT OF THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT. WHEREAS, at the April 20, 2012, Special Meeting of the Committee on Finance, Council Members raised serious questions and concerns regarding the operations of the County of Hawaii's Department of Environmental Management; and WHEREAS, these concerns include, but are not limited to, the lack of communication and transparency the department has demonstrated, in particular the County Council was not informed that a pilot program was being conducted to truck trash from Hilo to the Pu`uanahulu Landfill; and WHEREAS, the Department of Environmental Management oversees a number of programs that directly affect the health and safety of our community; and WHEREAS, Section 6-10.2 of the Hawaii County Charter provides that the Department of Environmental Management is established to protect, preserve, and enhance our environment by promoting the wise management of our waste; and WHEREAS, Section 6-10.4 of the Hawaii County Charter provides that the Department of Environmental Management shall manage the solid waste, wastewater, and recycling programs of the county, and exercise functions as prescribed by the mayor or prescribed by ordinance; and WHEREAS, Section 3-18(d) of the Hawaii County Charter provides in part that the Legislative Auditor shall conduct or cause to be conducted: "(2) Performance and/or financial audits of the funds, programs, services, and operations of any county agency, executive agency, or program as set forth by the legislative auditor in an annual audit plan that shall be transmitted to the county council and the mayor and filed with the county clerk as a public record"; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that it requests the Office of the Legislative Auditor to conduct a performance and financial audit of the Department of Environmental Management. BE IT FURTHER RESOLVED, that the Council requests the Office of the Legislative Auditor to add this request to its Fiscal Year 2012-2013 annual audit plan. BE IT FURTHER RESOLVED, that the findings and recommendations of the audit are intended to assist County government in its management of public resources, delivery of public services, and stewardship of public trust. BE IT FINALLY RESOLVED, that the County Clerk shall forward a copy of this resolution to the Honorable Mayor William P. Kenoi, the Director of the Department of Environmental Management, and the Office of the Legislative Auditor. Dated at , Hawai`i, this day of , 2012.
