Resolution No -583
RELATING TO A GRANT OF VARIANCE FROM THE APPLICATION OF SECTION 4B OF
ORDINANCE NO. 53 (DRIVEWAY APPROACHES), FOR PROPERTY DESCRIBED AS TMK
5-4-05: PARCEL I AT NORTH KOHALA, HAWAII.
WHEREAS,, Section 4B of Ordinance No. 53 (Driveway Approaches), prohibits
the construction of driveway approaches closer than thirty feet between the
driveway approaches; and
WHEREAS, Section 8 of said ordinance provides that the Board of Super-
visors, now County Council, may, by resolution, grant variances from the
strict application of the provisions of that ordinance after consultation
with the Planning Commission, and under certain conditions., to wit:
and
"A. The exception or variance desired arises from the developer
wanting to provide separate ingress and egress driveways for smoother
traffic flow within the parking area together with the full utiliza-
tion of the limited area including landscaping.
11B. That the exception or variance desired is not against the
public interest, particularly safety, convenience, and general welfare*
11C. That the granting of the permit for the exception or variance
will not adversely affect the rights of adjacent property owners or
tenants.
11D. That the strict application of the terms of this ordinance
will work unnecessary hardship and practical difficulty on the property
owner or tenant. 11
WHEREAS., the County Council having consulted with the Planning Director
and the Chief Engineer and having found that the above-mentioned conditions

have been met; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that a variance
from the application of Section 4B of Ordinance No. 53, as amended by Ordinance
No. 92., be granted for proposed driveways to Tax Map Key 5-4-05: Parcel
1; and
BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted
to Department of Accounting and General Services in Honolulu, Hawaii, and
the Chief Engineer and the Planning Director of the County of Hawaii.
