AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 5, SECTION 24-281 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PARKING. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: SECTION 1. The purpose of this measure was generated by a request to improve the flow of traffic through the Mohouli Street/Kilauea Avenue intersection. The Traffic Division is proposing to convert this area to a no parking at anytime area. In April 2012, the Traffic Division conducted a traffic study and found that the subject stalls were illegally used and when occupied, caused unnecessary congestion at the intersection. Also, found in the study was that there are stalls available throughout the day along Mohouli Street. In an effort to offset the loss of the three parking stalls, the Traffic Division will be looking to add as many stalls as possible along Mohouli Street between Kilauea Avenue and Kino`ole Street. SECTION 2. Chapter 24, Article 10, Division 5, Section 24-281, Schedule 29. Parking prohibited during certain hours on certain streets, subsection(c), South Hilo, of the Hawai`i County Code 1983 (2005 Edition, as amended), is amended by deleting item 18 and renumbering the subsequent items: [(18) Mohouli Street, on the Puna side, those three metered stalls mauka of Kilauea Avenue between 7:00 a.m. and 8:00 a.m. on school days.] SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance,the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
