AN ORDINANCE AMENDING CHAPTER 25, ARTICLE 2, DIVISION 4 AND
ARTICLE 6, DIVISIONS 4 AND 5 OF THE HAWAII COUNTY CODE 1983 (2005
EDITION, AS AMENDED), RELATING TO NOTIFICATION REQUIREMENTS FOR
ZONING AMENDMENT, PROJECT DISTRICT AND AGRICULTURAL PROJECT
DISTRICT APPLICATIONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 25, article 2, division 4, section 25 -2 -42 of the Hawai`i County
Code 1983 (2005 Edition, as amended), is amended by amending subsection (b) to read as
follows:
"(b) [Within ten days after filing an application for a change of zonc, the] The applicant shall
serve notice of the application for zoning amendment on surrounding owners and lessees
of record[;] as provided by section 25 -2 -4. The applicant shall also post a sign for public
notification on the property as provided by section 25- 2 -12."
SECTION 2. Chapter 25, article 2, division 4, section 25 -6 -44 of the Hawai`i County
Code 1983 (2005 Edition, as amended), is amended by amending subsection (b) to read as
follows:

serve notice of the application for project district on surrounding owners and lessees of
record as provided by section 25 -2 -4. The applicant shall also post a sign for public
notification on the property as provided by section 25- 2 -12."
SECTION 3. Chapter 25, article 2, division 4, section 25 -6 -54 of the Hawai`i County
Code 1983 (2005 Edition, as amended), is amended by amending subsection (b) to read as
follows:
"(b) [ . - - - - .. - - ] The
applicant shall serve notice of the application for agricultural project district on
surrounding owners and lessees of record as provided by section 25 -2 -4. The applicant
shall also post a sign for public notification on the property as provided by section 25 -2-
12."
SECTION 4. Material to be repealed is bracketed and stricken. Material to be added is
underscored. In printing this ordinance, the brackets, bracketed and stricken material, and
underscoring need not be included.
SECTION 5. If any provision of this ordinance, or the application thereof to any person
or circumstance, is held invalid, such invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the invalid provision or application, and to
this end the provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its approval.
