Your Committee on Planning, to which was referred Bill No. 190, transmitted jointly with Bill No. 189, by
Mayor Stephen K. Yamashiro per Communication No. 596, dated December 20, 1999, regarding the
change of zone request by Michael C. and Betty Jo Williams, at Ouli, South Kohala, Hawaii,
TMK: 6-2-I l:l 1, reports as follows:
Bill No. 190 amends Section 25-8-7 (North and South Kohala District Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code, by changing the district classification for approximately
6.7172 acres of land from an Agricultural (A-Sa) to a Residential and Agricultural (RA-2a) zoned district.
The rectangular shaped subject property, owned in fee by the applicants, is located within the Anekona
Estates Subdivision, a 36-lot subdivision, between Kawaihae Road and Kanehoa Street approximately
I .I 00 feet west of the Kawaihae Road-Kanehoa Street intersection.
The applicants are proposing to create a two lot subdivision using a 2.8958 acre portion near the Kanehoa
Drive and a 3.8214 acre parcel adjacent to the Kawaihae Road. The existing lot presently has an access
point off Kanehoa Drive that will accommodate the two proposed lots. Proposed Lot I I-A is tillly
developed with aone-story single-family residence and proposed Lot 11-B is undeveloped at this time.
The Economic, Housing, Land Use Residential Elements goals, policies and courses of action for South
Kohala are consistent with the General Plan. The General Plan Land Use Pattern Allocation Guide
(LUPAG) Map classification is Low Density, which allows for developments that are single family
residential in character, including ancillary communiTy and public uses, and convenience type commercial
U50S.
Under the present Zoning Code, the property is zoned Agricultural-5 acre (A-Sa); however, prior to the
adoption of the Zoning Code, the subject parcel was zoned Unplanned. The property is not situated within
the Special Management Area.
Surrounding areas are located within the State's Agricultural and Rural Districts and in the Countys
Agricultural 5-acre and I-acre, and Residential and Agricultural-2 acres zoned districts. Kanehoa
Subdivision, a 26-lot subdivision, is located immediately to the east and zoned A-Sa; Kamuela Plantations,
a 10-lot subdivision, is located further to the east and also zoned A-Sa; and Waimea Landmark Estates, a
26-lot subdivision, is located across Kawaihae Road and further to [he northeast and is zoned A-3a. These
subdivisions include single-family residential and agricultural uses and/or vacant lands. There are
approximately 25 lots with the Condominium Property Regime designation within the Anekona and
Kanehoa Subdivisions. The Ouli affordable housing project is located to the west of Anekona Estates and
is within the Sate Land Use Urban District. In June 1998, the County Council approved a State Land Use
Boundary Amendment from an Agricultural to Rural District and a Change of Zone from A-Sato RA-2a

fora 5.0 acre parcel, and a 5.588 acre parcel in September 1999 within the Kanehoa Subdivision. Similar
changes for four approximately 5.0 acre parcels in the Anekona Estates Subdivision were approved within
the past seven months. Similar land use changes were also approved in October 1996 for two 5-acre
parcels within the Kamuela Plantation Subdivision.
The ALISH classification for [he property is "Unclassified" and the Land Study Bureau's Detailed Land
Classification System is "E" (Very Poor). The soils are classified as Pu`u Pa extremely stony very fine
sandy loam. This surface layer is very dark brown extremely stony very fine sand loam about 6 inches
thick. Permeabiltiy is moderately rapid, runoff is medium, and the erosion hazard is moderate. These soils
are used for pasture.
The subject property is located within Zone X, an area determined to be outside the 500-year flood plain.
T'he undeveloped portion of the subject property is barren except for a few grasses and weeds. Common
animal species in the area include field mice and mongoose. There are no known or recorded rare or
endangered animal or plant life in the area.
According to the applicants' environmental report, no historic or archaeological sites were present on the
parcel. The property has been previously grazed by cattle; therefore, the proposed action will not have any
effect on significant historic sites.
Access to the subject property is from Kawaihae Road via Anekona Street to Kanehoa Street. Both
roadways have aright-of--way width of 50 feet with a 20-foot agricultural standard pavement.
Water is provided by an existing 4-inch waterline that fronts [he subject property. 'T'he property is situated
within the Critical Wastewater Disposal Area, so according to the Department of Health, the applicant
would be required to install a septic tank system since there is no municipal sewer system in the area. All
other utilities are or will be made available to the property.
Bill No. 190, Draft 2, which included the condition to prohibit second dwellings on the property, was
circulated and approved by Your Committee.
Committee Member Curtis Tyler questioned the need for a planting screen easement, which was suggested
in Kazu Hayashida's comments to Planning Director Virginia Goldstein. He also was concerned about the
access to the property, and the drainage study, which was suggested by the Department of Public Works.
Your Committee will look into these concerns.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 190, Draft 2, and
recommends it pass first reading.
