Resolution No. 141
RESOLUTION APPROVING AND PROVIDING FOR THE EXECUTION OF
A PROPOSED NEIGHBORHOOD FACILITIES GRANT CONTRACT
NO. HAWAII N -2(G).
WHEREAS, under Section 703 of the Housing and Urban
Development Act of 1965, the United States of America (herein
called the "Government") has tendered to County of Hawaii
(herein called the "Grantee"), a proposed Neighborhood Facilities
Grant Contract under which the Government agrees to make a
Grant to the Grantee to aid in financing a project, designated
Project No. Hawaii N-2; and
WHEREAS, the Grantee has given due consideration to said
proposed Contract; and
WHEREAS, the Grantee is duly authorized, under and pursuant
to the Constitution and laws of the State of Hawaii, to under-
take and carry out said Program and to execute such proposed
Contract.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII]
as follows:
SECTION 1. The proposed Contract, designated Neighborhood
Facilities Grant Contract No. Hawaii N -2(G), consisting of
Parts I and II, under and subject to the provisions, terms, and
conditions of which the Government will make a Neighborhood
Facilities Grant under Section 7.03 of the Housing and Urban
Development Act of 1965, to the Grantee to aid in "financing the
cost of a project, designated Project No. Hawaii N-2, situated
in Captain Cook, County of Hawaii, State of Hawaii, is hereby
in all respects approved.
SECTION 2. The Mayor of the County of Hawaii is hereby
authorized and directed to execute said proposed Contract in
two counterparts on behalf of the Grantee, and the County Clerk
is hereby authorized and directed to impress and attest the
official seal of the Grantee on each such counterpart and to
forward such counterparts to the Department of Housing and
Urban Development, together with such other documents relative
to the approval and execution thereof as may be required by
the Government.
SECTION 3. The Director of Finance of this Grantee is
hereby authorized to file requisitions, together with necessary
supporting documents, with the Government, from time to time
as Grant funds are required, requesting payments to be made to
it on account of the Grant provided for in the Contract, and
to do and perform all other things and acts required to be done
or performed in order to obtain such payments.

SECTION 4. The Grantee agrees to abide by all of the
provisions, terms and conditions of said Contract.

CERTIFICATE OF RECORDING OFFICER
The undersigned hereby certifies that:
1. He is the duly qualified and acting County Clerk
of the County of Hawaii (hereincalled the "Grantee"), and
the keeper of its records.
2. The attached resolution is a true and correct copy
of the resolution entitled: "RESOLUTION APPROVING AND PROVIDING
FOR THE EXECUTION OF A PROPOSED NEIGHBORHOOD FACILITIES GRANT
CONTRACT NO. HAWAII N -2(G)" as finally adopted at a meeting of
the Grantee held on the 3rd day of September 1969,
and duly recorded in his office.
3. The meeting was duly convened and held in all respects
in accordance with law and, to the extent required by law,
due and proper notice of the meeting, and a legally sufficient
number of members of the Grantee voted in the proper manner
for the adoption of the resolution. All other requirements
and proceedings under law incident to the proper adoption or
passage of the resolution have been duly fulfilled, carried
out, and otherwise observed.
4. If any impression of the seal has been affixed below,
it constitutes the official seal of the Grantee, and this
certificate is hereby executed under the official seal. If
no seal has been affixed below, the Grantee does not have and
is not legally required to have an official seal.
5. The undersigned is duly authorized to execute this
certificate.
