AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 1, SECTION 24-255 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO SPEED LIMITS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: SECTION 1. The purpose of this measure is to revise the speed limits along South Kulani Road. The Traffic Division's proposal is to keep the existing 25 mph speed limit from Volcano Road up until parcel 1-8-086:026. A new 35 mph speed limit will be installed from parcel 1-8-086:026 to three hundred feet northwest of the bridge 18-1. The rest of South Kulani Road will remain at 25 mph. SECTION 2. Chapter 24, Article 10, Division 1, Section 24-255, Schedule 3. 25 mile per hour limit, subsection (g)(29), Puna, of the Hawai`i County Code 1983 (2005 Edition, as amended), is amended to read as follows: (29) South Kulani Road, from Volcano Road to the property line between parcels 1-8- 086:026 and 1-8-086:027. SECTION 3. Chapter 24, Article 10, Division 1, Section 24-255, Schedule 3. 25 mile per hour limit, subsection(g), Puna, of the Hawai`i County Code 1983 (2005 Edition, as amended), is amended by adding the following to be appropriately numbered and to read as follows: ( ) South Milani Road, from a point three hundred feet northwest of bridge 18-1 to its southeastern terminus. SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 5. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 6. This ordinance shall take effect upon its approval.
