BILL NO. 240 ORDINANCE NO. 12 5 AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 6, SECTION 24-288 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO FREIGHT LOADING ZONES. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAN: SECTION 1. The purpose of this measure is for the loading zones in the Kailua Village area to have a start time and end time each day of 7:00 a.m. and 3:00 p.m. respectively. The request for the amendment came from the Hawai`i Police Department and received support from the Kailua Village Business Improvement District. The primary reason for the request was to open up more parking along Mil Drive. Parking in loading zones is allowed when the loading zones are not in effect. SECTION 2. The reason for deletion of subsection (f)(4) is that this particular loading zone is on Palani Road and not on Ali`i Drive. Ali`i Drive terminates at Ka`ahumai u Place (road to pier). SECTION 3. Chapter 24, Article 10, Division 6, Section 24-288, Schedule 36. Freight loading zones, subsection (f), Kona, of the Hawai`i County Code 1983 (2005 Edition, as amended), is amended to read as follows: (f) Kona (1) Ali`i Drive, [eastlnorth (mauka) side, [be-ginning] from a point two-hundred [seventy six]seventy-eight feet [north] west of Likana Lane and extending sixty feet in the [ffeft-lierly]yvesterly direction, [24-hours-daily]7:00 a.m. to 3:00 to,m. each day. (2) Ali`i Drive, [cast]north (mauka) side, [beginning]from a point five - hundred thirty - three feet [neft-la]west of Likana Lane and extending [forty six]forty -five feet in the [northerly]westerly direction, [2'1 hours daily]7:00 a.m. to 3:00 p.m. each day. (3) [ {� ) Ali`i Drive, [in Kailua Kona,]southwest { makai) side, [en]from a point four hundred sixty -one feet southeast of Likana Lane and extending ninety -nine feet in the southeasterly direction, in the curb cut -out [in front of the Kona Inn Shopping Center, south of Hulihec Palace], 7:00 a.m. to 3:00 p.m. each day. Ali`i Drive, in Kailua Kona, mauka side, in the vicinity of the Kona Galley.] [(5)](4)Ali`i Drive, [in Kailua Kona,]east ( mauka) side, [in the marked zone fronting the Moku'aikaua Church and the Kim Chong Building]from a point three hundred fifty -eight feet north of Sarona Road and extending thirty -four feet in the northerly direction, 7:00 a.m. to 3:00 p.m. each day. [(6)](5)Ali`i Drive, [west]southwest (makai) side, beginning from a point [on fifty four] one hundred fifty -five feet [south]southeast of Kakina Lane, and extending seventy -seven feet in the [southerly]southeasterly direction, 7:00 a.m. to 3:00 p.m. each day. [(7)](6)Ali`i Drive, west side, from a point three hundred - twenty feet south of Hualalai Road and extending sixty feet in the southerly direction, from 4:00 a.m. to 10:30 a.m., excluding Sundays and holidays. [(8)]OBelt Highway in Kainaliu, at Oshima Store. [(- 9)](8)Hanama Place, at its terminus The fifty -five foot section on the makai side fronting the Kailua Trade Center. [(4- 0)](9)Likana Lane, east side, from the edge of the County parking lot nearest Ali`i Drive and extending northwesterly for forty -four feet between the hours of 8:00 a.m. and 4:00 p.m. except Sundays and public holidays. [{14 ](10)Sarona Road, south side, beginning from a point one hundred eight -two feet east of Ali`i Drive and extending one hundred feet in the easterly direction. SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 5. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or 2 applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 6. This ordinance shall take effect upon its approval.
