RESOLUTION NO. 278 12
A RESOLUTION AUTHORIZNG THE DIRECTOR OF FINANCE TO COMPROMISE
REAL PROPERTY TAXES OWED BY THE ARC OF HILO ON A PARCEL
IDENTIFIED AS TAX MAP KEY: (3) 1-6-146-031
WHEREAS, The Arc of Hilo was established as a nonprofit 501(c)3 since 1955 assisting
the disabled citizens of the Big Island; and
WHEREAS, Section 19-77, Hawaii County Code 1983 (2005 Edition, as amended)
exempts property exclusively used for nonprofit purposes from real property taxes except for the
minimum tax; and
WHEREAS, the land parcel TMK: (3) 1-6-146-031 was leased by The Arc of Hilo, a
nonprofit organization, from the WH Shipman, Ltd., from February 1, 2009 to January 31, 2012;
and
WHEREAS, during the lease, the parcel has met all requirements of section 19-77 (b)(6),
Hawaii County Code 1983 (2005 Edition, as amended) except to submit an application for
exemption; and
WHEREAS, The Arc of Hilo paid real property taxes on various dates from August 1,
2009 through November 29, 2011, totaling $14,878.65; and
WHEREAS, The Arc of Hilo was unaware that a required separate tax exemption
application had to be filed to qualify for a tax-exempt status; and
WHEREAS, as a nonprofit organization serving the greater East Hawaii area, the
payment of a tax bill totaling $14,878.65, less $200 minimum tax, is a significant monetary loss
for this nonprofit organization to sustain in these difficult economic times; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that, in
accordance with Section 19-3(12), Hawaii County Code, the Director of Finance is authorized
to compromise and refund the sum of$14,678.65, being the amount of taxes paid between
August 1, 2009 and November 29, 2011 on the parcel identified as TMK: (3) 1-6-146-031 less
the minimum tax of$200 that would be due if the exemption were properly filed.
BE IT FINALLY RESOLVED that the County Clerk shall forward copies of this
resolution to the Honorable Mayor William P. Kenoi, the Director of Finance, the Administrator
of the Real Property Tax Division, and The Arc of Hilo.
