Aloha Mr. Onishi,
This letter is in regards to the change of zone application (REZ 11-000147).
The application should be denied due to these concerns:
1. Traffic safety. There is not enough parking for the density of the project.
There is no on street parking. The driveway is unsafe in times of heavy
traffic to have two cars enter and exit at the same time due to the
location of driveway. There is a rock wall on one side and a guard rail on
the other side. The driveway cannot be located at another location due to
the guard rail. Illegal parking would occur from the project. I would not be
able to see out of my driveway creating a major safety issue. A traffic light
should be installed for safety reasons. The traffic light may reduce the
traffic congestion at Puainako and Kino'ole intersection and the Kawili and
Kino'ole intersection during peak traffic hours.
2. Drainage and flooding issues. In 2008 roadside improvements were made
(Federal Aid Project #STP0100(059) drainage issues occurred after
completion of the project. Water did not drain from the affected area
which comprised my property and the proposed property to be rezoned.
Water did not drain from the affected areas for over 4 months. The
property is located in the new FEMA flood zone. Even with a dry well or
wells drainage system being installed on the project property, my property
would flood from the water table rising during periods of heavy rain and
flooding as the project property would be covered in concrete and asphalt
except for a very small set back areas. The project property does not
drain overland into gutters and drains.The project property drains into my

yard in time in times of heavy rain and flooding. There is a dry well on
Kino'ole street. This dry well has no effect on the project property.
Regarding the U.S.D.A. Natural Resources Service type. This report covers
very large areas so it is broad in its scope and may not reflect the soil
strata on the project property. After viewing the Kino'ole street project I
saw how sensitive the soil strata is to grubbing.
3. Noise and nuisance will be great from the project affecting the
neighborhood. There is no ambient noise generated from the project
property as it is vacant. Ambient noise levels will be high from this project.
Nuisance will be great. Police calls to the proposed property will be great.
4. Properties located next to the proposed project property will have their
property value decrease and it will be harder to sell the properties.
5. The scope and density of the project is too great for the site.

Staff, upon reviewing the provided documents and visiting the location, has the following
concerns.
The location of this development is surrounded by single family residential homes across the
street and on both sides of the complex. There is the likelihood that this complex will generate
police nuisance calls such as loud party and loud noise complaints affecting the quality of life of
residents living nearby.
The roadway has one lane for traffic in each direction and traffic in this area is constant with
high traffic flow during the morning and afternoon hours.
The parking area in the preliminary site plan identifies over 20 vehicle parking stalls. The plan
calls for 14 three-bedroom apartments to provide housing for University of Hawaii-Hilo students.
If this complex is built, it will have the potential to house more than 42 students without providing
sufficient parking.
Once again, the increase in population density will affect traffic and quality of life for nearby
residents and may increase police calls for service to this area.

your memo dated October 24,
2011 and offer the following comments for your consideration.
All development-generated runoff shall be disposed of on site and not directed toward any
adjacent properties. A drainage study shall be prepared and the recommended drainage
system shall be constructed meeting the approval of the Department of Public Works.
The subject parcel is in an area designated as Zone X on the Flood Insurance Rate Map
(FIRM) by the Federal Emergency Management Agency (FEMA). Zone X is an area
determined to be outside the 500-year floodplain.
All earthwork activity, including grading and grubbing,shall conform to Chapter 10, Erosion
and Sedimentation Control, of the Hawaii County Code.
The Zoning Map classifies Kinoole Street as a secondary arterial. It has an existing right-
of-way width of 55 feet fronting the subject parcel. The driveway connection to Kinoole
Street shall conform to Chapter 22, County Streets, of the Hawaii County Code.
Install streetlights and traffic control devices as may be required by the Traffic Division,
Department of Public Works. The applicant shall be responsible for the design, purchase,
and installation of such devices.

This letter is regarding my yard flooding due to the South Hilo Road Improvements
Kinoole Street (Job #P3398).
After this weekends heavy rain fall I was able to see how my yard drains.
There is very little drainage. Due to the construction the natural drainage has stopped
due to a soil strata interphase. I feel you have built a road in my yard.
I feel this drainage problem can be easily solved by digging out all of the soil and rock
that was dug out to install the wall on my property well below the compacted fill grade
of the wall.

After removing all of the fill in my yard a hammer drill should drill and loosen the
existing strata. Then the area should be filled with water from a water truck or from
natural rainfall if there is enough rainfall to see if the strata will perculate and drain.
I would then put in a few feet of drain rock and fill with top soil.
Please remove all material from my yard 2 ft below the concrete footing of the retaining
wall.
This work should take care of the problem.
Allen when we first spoke about this job you wanted to raise the level of my yard to
lessen the cost of the job. I said no because drainage problems could occur.

SUBJECT: ROADSIDE IMPROVEMENTS FOR VARIOUS SOUTH HILO ROADS
FEDERAL AID PROJECT NO. STP-0100(059)
TMK: 2-2-038:018 PONDING FRONTING OF PROPERTY
Thank you for meeting with us yesterday. As we agreed with you on our site visit,the construction area fronting your
property above, approximately bounded by the new retaining wall, undisturbed lawn area and the adjacent Chong lot
(TMK: 2-2-038:017)will be excavated down approximately two to three feet in depth to the rock layer. To minimize
disturbance and undermining of the new retaining wall,the excavation shall not be less than two feet from the wall.
The excavated area will be backfilled with black cinder soil landscape mix from Sanford's Service Center Inc. The
finish grade of the backfill shall provide a positive drainage from the wall to the existing lawn.
It was also agreed that the extent of the above work shall be the only work the County will provide for the above
issue. You will not be afforded any additional work from the County to mitigate this issue in the future.
As explained, after the project is completed,the existing runoff onto your property and in the area will be improved
due to the construction of the swale and drywell. However, during heavy storm events or in cases where the runoff is
more than the capacity of the drywell,the overflow runoff will flow similar to pre-project condition including possible
runoff flow onto your driveway and low lying areas.
The above work will be done by the County or its Contractor. If you agree, kindly signify your acceptance and
concurrence of the above by signing in the space provided below by Friday,January 9, 2009. We request to call us
when the signed original is ready to be picked-up. A copy is included for your files.
We greatly appreciate your cooperation and for working with us in the construction of this project. Should you have

Regarding my property at 1605 Kinoole St(TMK2-2-038:018).
The area of my property that was damaged during the Roadside Improvement#STP0100(059)
has not yet been restored to the existing condition the property was in before the project began.
When re-installing my fence I ran string lines to find the property line. I found that my property is still
12 to 18 inches lower than it was before construction started.
I was told by Alan Simeon and various staff from Isemoto Contracting including Jason that the last phase of
the project was to bring in good soil and place the soil at the bottom of the retaining wall weep hole and
would be graded from said wall to the existing land area.Thus the soil would be graded to give positive
drainage from the wall into my yard.
To date the job is not complete.The soil was never placed to the bottom of the weep holes. It was placed 6
inches plus under the weep holes.This is one reason why my yard is 12-18 inches lower.When you
purchased the 5 feet of property that also changed the topography. Perhaps that 5 ft was not taken into
consideration when the project was engineered.The fact you shot your elevations without first grubbing the
Chong property also is a factor.
During the excavation phase to try to correct the damage to my property I took some measurements to see
how much material was needed.9-10 truckloads(Black cinder soil mix)from Sanford were required.To
date 3 loads were delivered to my property.
Sink holes are now occurring in my yard. I also noticed a lot of pre-existing soil was mixed in with the
cinder soil mix that was put in the construction area of my property.
My request is for 3 more truckloads of material from Sanford rather than 6 more truckloads of material from
Sanford since my fence is up and trees are planted.

Regarding safety and liability issues at my property(TMK-2-038:18).
I spoke with Mr.Simeon about installing No Parking signs(vehicle will be towed)in front of the Road side Improvement
#STP0100(059).Mr.Simeon also informed me that no parking strips would be painted on the road side between the
Chong property driveway to my drive way.I am requesting this work be done because when vehides are parked on the
road shoulder by the guard rail,the line of sight is gone turning left out of my drive way toward Puainako Street.This is a
major liability if am involved in an automobile accident.Please have Mr.Simeon contact me with the contact information
for the State Dept.of Transportation regarding my road side request.I understand how busy you are with all of these
road side improvement projects.
Regarding safety and liability in my yard.I am requesting 3 more loads of Black Cinder Soil Mix delivered to my property
from Sanford.I now have a sink hole that is slowly becoming larger.I do not know how many more will appear when I
dig holes to re-landscape.During the excavation of the sub-soil and the hammer drilling to bring back friability to the soil
the operator found some very soft areas and drilled deeply in those areas for better drainage. I applied 500 pounds of
Gypsum Prills to the entire area to enhance sub-soil friability and drainage before the Cinder Soil Mix from Sanford filled
the hole.I do not know how much sub-soil was put in the Puna side of the hole.The mixing of the sub-soil and Sanford
material may cause sink holes as the material settles.No sub soil was to be put back in the damaged area just the
Sanford material.
Mr.Simeon asked me why I did not want the area in question compacted.That would have once again dosed up the sub-
soil strata.
Due to the natural water course being changed so now the water floods into my property from the Chong property I had
to build a hillock and bury roofing tin along the fence line to prevent water entering my property.
Another factor that shows the natural water course has been changed by this roadside improvement is the fact that the
weep hole by the property pin between the Chong property and my property is now 12-18 inches below the soil surface.
This is why I am requesting 3 truck loads of material.The material will settle naturally.Seep holes will not occur. My
property should sit higher than the Chong property to protect my property from any more damages.

Per our telephone conversation with you on March 13, 2009, we agreed to give you one additional load of
26 C.Y. cinder soil from Sanford's Service Center, Inc. It will be end dumped on your property and it will
not be installed by the County or its Contractor, you will be responsible in placing it behind the new
retaining wall fronting your property. Make sure that the weepholes are not buried.
For your information, though we disagree with your letters dated March 8 and 12, 2009, in an effort to put
a closure on this issue, but in no way to mean an admission of guilt by the County, we made and agreed
on the above offer.
As mentioned, this is the final offer and you will not be afforded any more additional work or
compensation from the County to mitigate this issue in the future. If you agree, signify your formal
acceptance and concurrence of the above, and release the County of any further claim upon the delivery
of the additional one(1)Toad cinder soil, by signing in the space provided below.
As far as the "No Parking"signs, we are currently working with our Traffic Division regarding warrants and
placement. The new shoulder area will be striped.
