Due to the global nature of the food industry, the reality of enforcing this resolution will be a nightmare. If the distributor/grower does not label the product or advise the retailer that the product is GMO then the retailer is potentially liable for the mislabeling. A retailer cannot identify a GMO product by visual or taste inspection. This resolution is not practical from an enforcement point of view and it interferes with interstate commerce, which may be unconstitutional. Legislation regarding labeling of products should be dealt with at a federal level, with the onus for labeling resting with manufacturers and suppliers, not retailers. Due to the tremendous size of the food industry, the reality of enforcing this resolution will be a nightmare. It has been estimated that the majority of manufactured food products contain some sort of Genetically Modified ingredients, whether it be among others corn, soybean, cottonseed oil, or canola. If the distributor, grower or manufacturer does not label the product or advise the retailer that the product contains GMO ingredients, then the retailer is potentially liable for the mislabeling. A retailer cannot identify a GMO product by visual or taste inspection. This resolution is not practical from an enforcement point of view and it interferes with interstate commerce, which may be unconstitutional.
