Yamashiro per Communication No. 733, dated April 5, 2000, regarding the change of zone request by Thomas C. Chen at Waiakea, South Hilo, Hawaii, TMK: 2-2-20:1 1, reports as follows: Bill No. 239 amends Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 19,724 square feet of land from a Single Family Residential (RS-10) to a General Commercial (CG-7.5) zoned district. The rectangular shaped property, owned in fee by Thomas C. and Jean J. Chen, is located on the northwest corner of the Kinoole Street-Wailoa Street intersection, across the former Sun Sun Lau Restaurant. The applicant is requesting the change of zone to allow general commercial uses on the subject property. The property is currently the site of four doctor's offices, but the applicant who is now retired from his practice due to a variety of physical ailments, would like the flexibility to expand the use of his property to include general commercial uses as well as doctor's offices. The relatively level property houses a 4,400 square foot one-story building containing four office spaces and a 26-lot parking area. On December 19, 1984, the Planning Commission approved Use Permit No. 23 for a doctor's office. On December 13, 1990, the Planning Commission approved an amendment to Condition 4 (restriction to two doctors) to lift the restriction on the number of physicians allowed to practice on the site. The State Land Use designation is Urban. The General LUPAG Map designation is High Density Urban, which allows for commercial, multiple residential and related services; therefore, this request is in compliance with the General Plan. The Hilo Community Development Plan, which was adopted by the Planning Commission in 1975 by Resolution, recommended the area for Double Family Residential (RD-3.75) zoning. The ALISH designation is Urban Development. The subject property is not located within the Special Management Area. The subject property is within Zone "C", an area of minimal flooding. The U.S.D.A. Soil classification is Keaukaha, which consists ofwell-drained, thin organic soils overlying pahoehoe lava bedrock, with medium runoff and slight erosion hazard. The Land Study Bureau Soil Rating is Urban. Since the site has previously been improved, the likelihood of any archaeological features and impacts to flora and fauna are minimal. PC-95 PC-95 Page 2 April 18, 2000 There are dwellings on the adjacent parcels to the west and south, and surrounding parcels are zoned RS-10 and CG-7.5. Northeast on Kinoole Street approximately 200 feet from the subject parcel are parcels zoned CG-20. Located approximately 630 feet from the property is a parcel zoned CG-7.5. Access to the subject property is from Kinoole Street, a County roadway with a 40-foot pavement within a 60-foot right-of--way. The Department of Public Works recommends that the applicant remove the existing non-conforming abandoned driveway on Kinoole Street located l 5 feet north of the existing parking lot driveway, and that a concrete sidewalk be constructed in its place. Water is available to the site from an existing 5/8-inch meter fronting the subject property. All other essential utilities and services are available to the site. Your Committee did not entertain any discussion on this measure, except for Committee Member Aaron Chung's explanation that this area is becoming more commercial so he has no objections to this change of zone request. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the change of zone request. Your Committee on Planning is in accord with the intent and purpose of Bill No. 239 and recommends it pass first reading.
