Your Committee on Finance, to which was referred Resolution No. 274-12, reports as follows:
Resolution No. 274-12, transmitted jointly with Bill No. 278, by Finance Director Nancy Crawford
via Communication No. 772, dated June 28, 2012, authorizes the Mayor to enter into an agreement
with the State of Hawai Department of Health, Alcohol and Drug Abuse Division, in order to
commence this program.
The State of Hawai`i Department of Health, Alcohol and Drug Abuse Division (ADAD) is providing
funds for the purpose of supporting the Police Department's efforts to conduct enforcement
operations of minors purchasing tobacco. The department will conduct a minimum of six
enforcement operations, using plain clothes officers to observe purchase attempts by minors and to
cite any retail store which makes an illegal sale to a minor. They will also establish procedures to
orient and supervise youth and adult volunteers to ensure their safety and compliance with
operational procedures and assign planning and supervisory staff to ensure that operations are carried
out in accordance with State law and Hawai County Police Department procedures.
Pursuant to Section 46-7, Hawaii Revised Statutes, County Departments must obtain the consent of
the Council to enter into agreements with the Federal or State governments respecting action to be
taken pursuant to any of the powers granted by law to furnish, expend and receive any funds or other
assistance in connection with projects being or to be undertaken pursuant to those powers.
There was no discussion on this measure.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 274-12, and
recommends its adoption.
