Your Committee on Planning, to which was referred Bill No. 278, transmitted by Mayor
Stephen K. Yamashiro per Communication No. 821, dated Junel9, 2000, regarding the change of zone
amendment request by Liliuokalani Trust, at Keahuolu, North Kona, Hawaii,
TMK: 7-4-15:15 (Portion), reports as follows:
Bill No. 278 amends Ordinance No. 91-27, which reclassified lands from an Open (O) to a Village
Commercial (CV-10) zoned district for 0.874 acres of land, by amending Condition C (Secure Final Plan
Approval), and deleting Conditions B (Final Subdivision Approval) and E (Donation of Land). The
applicant is seeking a 10-year time extension to fulfill the requirements outlined in Condition C for Final
Plan Approval to be secured from the Planning Department. Conditions B and E have been complied with
and all necessary actions by the Trust have been completed.
The rectangular-shaped subject property, owned in fee by the applicant, is located along the makai side of
Queen Ka`ahumanu Highway between Eho Street and the Kona Coast Shopping Center and is vacant of
any structures or uses.
In 1970, the applicant submitted a change of zone application for a portion of the subject parcel consisting
of 7.2 acres of land to change from a General Industrial-1 acre (MG-1 a) to Village Commercial-I 0,000
square feet (CV-10) zoned district. A 50-foot wide strip of land fronting the then Kailua-Kawaihae Road
was depicted on the site plan submittal as a buffer strip.
On June 3, 1987, Ordinance No. 400 reclassified approximately 6.143 acres of land from General
Industrial-1 acre (MG-1 a) to Village Commercial (CV-10).
On March 21, 1991, Ordinance No. 91-27 reclassified approximately 0.874 acres of land from Open to
Village Commercial. This request was conditioned upon retaining a 62-foot wide open strip fronting
Queen Ka`ahumanu Highway.
On May 24, 1993, Final Subdivision Approval was granted by the Planning Director for athree-lot
subdivision Lot 8-A, 8-B for Eho Street Extension and Lot 8-C (for highway widening).
On August 1, 1994, a dedication deed was executed by the Liliuokalani Trust, which donated a 62-foot
wide strip of land fronting the project site for roadway purposes as required by Condition E of Ordinance
No. 684.
On July 10, 1998, Final Subdivision Approval to the Slate Department of Transportation was granted by
the Planning Director for 19 parcels required for the construction of the widening of Queen Ka`ahumanu
Highway.

This request is consistent with the General Plan and the LUPAG Map allows for High Density Urban
Development and Urban Expansion. The Kona Regional Plan land use concept map designates the subject
area for General Commercial use. The subject property is located within the Kailua Village Special
District (KVSD) and also within the Keahole to Kailua Development Plan, which identifies the property
for Urban expansion. The property is not situated within the Special Management Area.
Surrounding property are zoned CV-1Q CG-20 and MG-la. To the south of the property is the Kona
Coast Shopping Center. To the west are lots that comprise the Kona Industrial Subdivision, which include
various industrial buildings and activities. To the east are other Queen Liliuokalani Trust lands, which
include the Makalapua Center and to the southwest is the Lanihau Shopping Center.
The property is located within Zone X, an area determined to be outside the 500-year flood plain.
The USDA Soil Survey Report classifies the soils as Pahoehoe and Punaluu. The AL[SH System has not
classified the soils. The Land Study Bureau's overall master productivity rating for agricultural use is
Class "E" or Poor.
Access to the proposed development is proposed via the 60-foot easement, which would serve as an
extension from Eho Street to Queen Ka`ahumanu Highway.
Water is available to the property from aone-inch meter. Electrical and telephone services will be made
available to the property.
Mr. James Bell of Belt Collins distributed copies of a map to Your Committee showing the sequence of
events over athirty-year period and, thereby, explaining the need for the time extension to complete their
projected plans. He also updated Your Committee with a brief history of the project.
Your Committee concurs with the Planning Commission and the Planning Director for recommending a
favorable consideration for the change of zone request for the time extension.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 278, and recommends it
pass first reading.
