Your Committee on Planning, to which was referred Comm. No. 526/Bill No. 168, reports as
follows:
Bill No. 168 transmitted by Mayor William P. Kenoi, via Communication No. 526, dated
December 21, 2011, is an ordinance amending section 25-8-23 (Mountain View Zone map),
Article 8, Chapter 25 (Zoning Code) of the Hawai`i County Code 1983 (2005 Edition), by
changing the District Classification from Single Family Residential— 10,000 square feet(RS-10)
to Village Commercial— 10,000 square Feet (CV-10) at `Ola`a, Puna, Hawai`i, covered by Tax
Map Key: 1-8-002:064. Also enclosed was a favorable recommendation from the Windward
Planning Commission Chair Zendo Kern.
At the January 19, 2012 Planning Committee, Attorney Kenny Goodenow, representing neighbor
Susan Langer, who opposes this zone change request, presented a PowerPoint presentation
outlining Zoning and General Plan precedents, and traffic increase concerns, plus the lack of a
need for an auto repair shop business. There was discussion regarding the intended use of the
property and the zoning, as well as the possible traffic increase through a dangerous intersection.
Bill No. 168 was postponed to the Call of the Chair to allow the applicants and neighbors to meet
with a mediator.
At the May 16, 2012 Planning Committee, Aubrey Summers, representing the applicants Donny
Souza&Melissa Mulliken, presented a PowerPoint presentation showing that the Puna
Community Development Plan (PCDP) identifies the parcel within the Community Village
Center boundary, and the Land Use Pattern Allocation Guide medium density boundary also
includes the parcel. She also stated that both the Planning Department and the Planning
Commission recommended a favorable determination for the applicants. At the May 16, 2012
Planning Committee, Bill No. 168 was again postponed to the Call of the Chair.
Applicants Donny Souza& Melissa Mulliken and their representatives Aubrey Summers and
Charles Umemoto were present in Hilo. Mr. Souza stated that since the last postponement they
have taken ownership of Nichols Road on July 9, 2012 and he has obtained his State Mechanics
License.
