On July 27, 2012, Judge Kobayashi granted the Defendants' motion for summary
judgment, thereby dismissing this matter. Therefore, it is no longer necessary to discuss
settlement of this matter with Council on August 15, 2012 and I respectfully request my
letter dated July 24, 2012 be withdrawn.
