Your Committee on Planning, to which was referred Bill No. 283, transmitted jointly with Bill No. 282 by
Mayor Stephen K. Yamashiro per Communication No. 843, dated July 5, 2000, regarding the change of
zone request by Susan and Sheldon Spencer, at Ouli, South Kohala, Hawaii, TMK: 6-2-11:36, reports as
follows:
Bill No, 283 amends Section 25-8-7 (North and South Kohala District Zone Map), Article 8, Chapter 25
(Zoning Code) of the Hawaii County Code by changing the district classification for 5.0014 acres of land
from an Agricultural (A-Sa) to a Residential and Agricultural (RA-2a) zoned district.
The rectangular-shaped subject property, owned in fee by the applicants, is located in the 36-lot Anekona
Estates Subdivision at the western corner of Kawaihae Road and Anekona Street intersection, and across
the Waimea Landmark Estates.
The applicants are proposing to create atwo-lot subdivision consisting of approximately 2.5 acres each.
One parcel will he retained by the applicants and the other pazcel will be sold.
The General Plan LUPAG Map designation is Extensive Agricultural, which includes pasture and range
lands. 7'he current County zoning is A-Sa and prior to the adoption ofthe 1996 Zoning Code, the subject
parcel was zoned Unplanned. The property is not situated within the Special Management Area.
Surrounding lands are zoned A-Sa, A-la, RA-2a and are located within the State Land Use Agricultural
and Rural districts. The Kanehoa Subdivision, a 26-lot subdivision, is located immediately to the east and
zoned A-Sa. Kamuela Plantations, a 10-lot subdivision, is located further to the east and also zoned A-Sa.
Waimea Landmark Estates, a 26-lot subdivision, is located across the Kawaihae Road further to the
northeast and zoned A-3a. These subdivisions include single-family residential and agricultural uses
and/or vacant lands. Approximately 25 lots within the Anekona Estates and the Kanehoa Subdivisions
have subdivided through the Condominium Property Regimes. The Ouli affordable housing project is
located to the west of Anekona Estates and is within the State Land Use Urban District.
The soils found on the subject property are classified as Pu`u Pa, which is an extremely stony very fine
sandy loam with moderately rapid permeability, medium runoff; and moderate erosion hazard. These soils
are used for pasture. The Land Study Bureau Soil rating is "E" or Very Poor. The ALISH rating is
Unclassified.
The subject property lies in Zone X, an area determined to be outside the 500-year flood plain.
There are no known rare or endangered flora and fauna on the site. There are also no known historical or
cultural features on the parcel. Because the site was previously used for cattle grazing, it is expected that
no archaeological features exist on the property.

Access to the property is from Kawaihae Road to Anekona Street to a roadway easement with an
approximately 20-foot pavement width. Kanehoa Street, located at the eastern portion of the subdivision,
is a connector road into the adjacent Kanehoa Subdivision.
Water is available through a 4-inch waterline fronting the subject property. According to the Department
of Health, the property is located in the Critical Wastewater Disposal Area where cesspools are not allowed
because of water pollution concerns; therefore, a septic tank system needs to be installed.
All utilities and services are or will be made available to the subject property.
Bill No. 283, Draft 2, which included the water commitment in Condition C and prohibits the construction
of a second dwelling unit on each lot in Condition I, was also agendized and approved at today's meeting.
Committee Member Curtis Tyler proposed to further amend Condition F to read as follows:
A I 0-foot wide planting screen easement along Kawaihae Road shall be provided, and
[the property's frontage on] no direct vehicular access to or from Kawaihae Road shall be
[rnarked "No Access Permitted."] permitted.
He also further amended Condition 1 to clarify that the Planning Director can execute the document with
the approved covenant(s) as follows:
Restrictive covenants in the deeds of all the proposed residential lots within the subject
property shall prohibit the construction of a second dwelling unit on each lot. A copy of the
proposed covenant(s) to he recorded with the Bureau of Conveyances shall be submitted to the
Planning Director for review and approval prior to the issuance of Final Subdivision Approval. A
copy of the approved covenant(s) shall be recited in an instrument executed by the applicant and
the County Planning Director and recorded with the Bureau of Conveyances for any portion of the
subject property. A copy of the recorded document shall be filed with the Planning Department
upon its receipt from the Bureau of Conveyances.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for recommending a
favorable consideration for the change of zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 283, Draft 2, as amended
to Draft 3, and recommends it pass first reading.
