Your Committee on Planning, to which was referred Bill No. 292, transmitted by Mayor
Stephen K. Yamashiro per Communication No. 866, dated July 21, 2000, regazding the change of
zone amendment request by Keauhou Sunset Corporation, at Kahaluu, North Kona, Hawaii,
TMK: 7-8-14:90, reports as follows:
Bill No. 292 amends Ordinance No. 96-104, which amended Ordinance Nos. 89-78 and 93-67
which reclassified lands from a Single Family Residential (RS-7.5) to a Multiple Family
Residential (RM-1) zoned district for 32,205 square feet of land, by amending Condition E to
specify the effective commencement and completion construction dates.
The rectangular shaped property, owned in fee by Keauhou Sunset Corporation (formerly Luri
Corporation), is located mauka of Ali`i Drive across from Kahaluu Beach Pazk. The Makole`a
Trail is located on the adjacent property to the south, and the Great Wall of Kuakini, which was
recommended for preservation, is located on the west boundary.
On February 22, 1989, SMA Use Permit No. 282 was approved to allow the construction of a
32-unit apartment/condominium complex. On June 13, 1989, Ordinance No. 89-78 was
approved. On June 27, 1990, a time extension to Condition B (to secure Final Consolidation)
was granted until June 13, 1991, but the Final Consolidation was approved on October 23, 1990.
On July 26, 1993, Ordinance No. 93-67 allowed the modification of Condition C relating to the
securance of Final Plan Approval and the insertion of new Condition D relating to the required
water commitment payment to the Department of Water Supply. On July 20, 1995, Final Plan
Approval was granted for the construction of the 32-unit apartment building, and on September
l9, 1996. Ordinance No. 96-104 an amendment to Condition E granted a 5-year time extension
to begin construction of the project.
The State Land Use District designation is Urban, and the LUPAG designation is Medium
Density Urban Development. The Kona Regional Plan permits residential uses at a density of 15
units per acre. The County Zoning is Multiple Family Residential (RM-1), and the property is
situated within the Special Management Area. The subject property is located within the
Kahaluu Historic District, and in conformance with Chapter 343, HRS, a Final Environmental
Impact Statement was filed.

The surface soil in the area is Punaluu, which is an extremely rocky peat with rapid permeability,
slow runoff and a slight erosion hazard. The Land Study Bureau's rating is "E" or "Very Poor".
There are no ALISH Map classifications. The property is located within Zone X, an azea outside
the 500-year flood plain.
The surrounding properties are zoned Resort-Hotel. To the east are properties zoned Multiple
Family Residential (RM-3) and Single Family Residential (RS-7.5). The Helani Church is
situated 130 feet to the north. Kahalu`u Beach Park is located to the west and makai of Ali`i
Drive. Kona Botanical Gazdens and Cultural Park is located to the south. Across Ali`i Drive to
the immediate south is the Keauhou Beach Hotel and Kona Lagoon Hotel. The property does not
abut the shoreline and is located mauka of Ali`i Drive approximately 900 feet from the shoreline.
Access will be from Makole`a Street, a County maintained roadway with a 20-foot wide
pavement and right-of--way width of 60 feet. Makole`a Street has been considered for an
east/west connector road between Ali`i Drive and the proposed Keauhou-Kailua Highway.
Water is available to the property via connection to an existing 8-inch waterline along Makole a
Street. Connection to the Keauhou Wastewater Treatment Plant will be done. Electrical and
telephone services are available to the property. Police, fire, emergency medical and paramedical
services are available at the surrounding locations.
Committee Member Curtis Tyler proposed two amendments. The first was to amend
Condition E by stating "construction shall commence within three yeazs" instead of five years;
and the second was to insert the following sentence to the end of Condition H:
"An interpretation/mitigationptan for the subject property and specifically the Makole`a
Trail, shall include buffer zones, a system for perpetual public access, signage and long
range preservation concerns, including possible relocation along the southern boundary of
the subject property, and shall be submitted to the Planning Director prior to building
permit approval."
Committee Member Julie Jacobson stated that she is not supporting this project because she
doesn't see where they're "really helping the public need by going ahead with this" project since
it is a "real increase in density neaz a public park here..."
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request.

Your Committee on Planning is in accord with the intent and purpose of Bill No. 292, as
amended to Draft 2, and recommends it pass first reading.
