Your Committee on Planning, to which was referred Bill No. 293, transmitted by Mayor Stephen K.
Yamashiro per Communication No. 867, dated July 21, 2000, regarding the change of zone request by
K.R.S. Development, Inc., at Lanikepu, Waimea, South Kohala, Hawaii, TMK: 6-2-1:91, reports as
follows:
Bill No. 293 amends Section 25-8-11 (Lalamilo-Puukapu Zone Map), Article 8, Chapter 25 (Zoning Code)
of the Hawaii County Code, by changing the district classification for 27.17 acres of land from an
Agricultural (A-40a) to an Agricultural (A-Sa) zoned district.
The triangular-shaped subject property, owned in fee by the applicants, is located along the west side of the
Kohala Mountain Road approximately 1,200 feet north of its intersection with Kawaihae Road and north
of the Lalamilo Houselots and Subdivision. The parcel is presently vacant and unused, although it was
previously used, periodically, as a cow pasture.
The Planning Department supported the boundary amendment, which was approved by the State Land Use
Commission on April 20, 1987, when the Richard Smart Revocable Personal Trust requested to change
approximately 404.34 acres for the proposed master planned development of the Parker Ranch 2020 Plan
from an Agricultural to an Urban district. On June 15, 1992, Ordinance No. 92-65 rezoned lands in and
around the village of Waimea for the Parker Ranch 2020 Plan. Part of the Plan proposed an approximately
229-acre Rural-Residential area located on the western edge of Waimea Town, to be developed into
approximately 80 residential lots and 35 residential/agricultural lots. As part of this area, the subject
property was rezoned from Agricultural (A-40a) to Single-Family Residential (RS-20). However, shortly
after the approval of Ordinance No. 92-65, Mr. Richard Smart passed away and the majority of his assets,
including Che lands described in Ordinance No. 92-65, were placed in the Parker Ranch Foundation Trust
to benefit the Waimea community.
In 1994, Parker Ranch began to revise its 2020 Plan, and in 1996, Ordinance No. 92-65 was amended to
consolidate the planned residential development to the Town Center area and delete the proposed Rural-
Residential area at the western edge of the town. This change was intended to utilize the existing and
planned infrastructure improvements and minimize potential impacts to area roads.
On September 26, 1996, Ordinance No. 96-1 17, which amended Ordinance No. 92-65, restored the
original Agricultural (A-40a) classification.
On September 18, 1999, it was determined that the entire subject parcel was, indeed, two separate parcels,
therefore, a new TMK was requested and the subject parcel was then identified as TMK: 6-2-I :91.

The applicant is proposing to change the zoning to A-Sato subdivide into five agricultural lots in
conformance with the new zoning designation.
The LUPAG Map designates the area of the subject property as Low Density Urban Development. The
Waimea Design Plan, adopted by the County Council on October 1, 1986, does not incorporate the subject
property, which is located on [he outskirts of the Plan.
The property is not situated within the Special Management Area.
Surrounding properties to the north and west of the subject property include several large parcels owned by
the Richard Smart Trust and the State of Hawaii, which are zoned Agricultural (A-40a). Farther to the
west is the Kamuela View Estates, which is zoned Single-Family Residential (RS-15). To the east and
south are the Lalamilo House Lots and Subdivision, which are zoned Single-Family Residential (RS-10).
Further to the east is the Hawaii Preparatory Academy whose lands are also zoned Single-Family
Residential (RS-10).
The ALISH Map classifies a portion of the property as Other Important Agricultural Land, and the balance
is not classified as having any agricultural importance. Lands within the subject property are classified as
"C" (Fair) and "D" (Poor). The USDA Soil Conservation Service Soil Survey classifies soils within the
subject property as those of the Waimea Series, which is an extremely stony very fine sandy loam with
moderately rapid permeability, slow runoff and slight erosion hazard.
The majority of the subject property is located within Zone X, an area determined to be outside the
500-year flood plain. A small portion of the site is in Zone A, an area with no base flood elevation
determined.
The applicant's environmental report concludes "that no significant adverse environmental impacts relative
to flora are anticipated as a result of proposed development in the azea." The only resident native bird
species observed in the area was the Pueo, and the only feral mammals observed on the property were
mongoose, with evidence of feral pig activity and indirect evidence of rodents.
The subject property is within the Waimea Field System, a large prehistoric complex of residential and
agricultural features. Studies conducted on the site recommend the preservation of some of the
discoveries.
Access to the property will be from the Kohala Mountain Road near the eastern end of the property. Water
is available from an eight-inch waterline in the Kohala Mountain Road and because there is no municipal
sewer system in the area and the property lies in a Critical Wastewater Disposal Area, a minimum lot size
of five acres will permit the installation of a cesspool. All solid waste will be disposed of at the
Puuanahulu landfill.
Electrical and telephone services are or will be available to the property and all services are available to the
property.

Committee Member Curtis Tyler proposed to amend Conditions 4, 5, 7, 9, 1 1 and 12 and K.R.S. planning
consultant, Greg Mooers, stated that his client was in agreement with the following amendments:
Conditions 4. and 5. Add language that says the improvements will be paid by the developer.
Condition 7. Add "if required" at the beginning of the second sentence.
Condition 9. Add language to the end of the paragraph that states CPRs will not be permitted and
density will not be increased beyond the permitted five single family dwellings.
Condition 12. Add language that states the property is located in a Critical Wastewater Treatment
area, so septic tanks will be used instead of cesspools.
New Condition 13. Add language to have a solid waste plan approved by the Department of
Public Works.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for recommending a
favorable consideration for the change of zone request.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 293, as amended to
Draft 2, and recommends it pass first reading.
