Your Committee on Planning, to which was referred Bill No. 311, transmitted by Mayor
Stephen K. Yamashiro per Communication No. 907, dated August 22, 2000, regarding the
change of zone amendment request by James C. Clay, at Puaa 3rd, North Kona, Hawaii,
TMK: 7-5-18:15, reports as follows:
Bill No. 3 ] 1 amends Seckion 25-8-5 (Kailua Urban Zone Map), Article 8, Chapter 25 (Zoning
Code) of the Hawaii County Code, by changing the district classification for approximately
3,789 square feet of land from a Multiple Family Residential (RM-1) to a Village Commercial
(CV-10) zoned district.
The subject property, owlned in fee by the applicant, is located approximately 250 feet south of
the Alii Drive-Walua Ro d junction on the mauka side of Alii Drive and adjacent to
Tom Bombadil's Baran Restaurant. The applicant would like to construct three parking spaces
to supplement the existi g parking provided at the adjacent professional office building located
immediately mauka of t e subject property, which was allowed by Ordinance No. 96-34 on
March 18, 1996.
The Hawai' i County Ge eral Plan LUPAG Map classifies this azea as Medium Density Urban,
which is defined as villa e and neighborhood commercial and residential and related functions
(3-story commercial, res dential-up to 36 units per acre.) The Kona Regional Plan designates the
area for Village Comme cial (CV) uses. The Master Plan for Kailua-Kona, adopted by the
Council in 1996 via Res lution No. 371-96, recommends the subject area for High Density
Residential uses. The C unty designates this azea as Multiple Family Residential-1,000 square
feet per unit (RM-1). T e subject property is located within the County's Special Management
Area (SMA).
The subject property co sitts of the Punaluu Series soil, which consists ofwell-drained thin
organic soils over paho hoe lava bedrock. According to the applicant, the subject property has
been altered with past g ading activities; therefore, it is unlikely that the subject property will
contain any significant istorical sites or artifacts or provide a habitat for endangered species of
plant or animal.
The subject property is ocated in Zone "X", an area located outside of the 500-yeaz flood area.

The project site will utilise an existing driveway access onto Walua Road.
Surrounding land uses ad~acent to the subject property consist of an existing commercial office
complex located adjacen to the east (mauka) on lands zoned Commercial (CV-10), a
restaurant/office comple to the north on lands zoned Resort (V-.75) and vacant lands to the
south on land zoned Vill ge Commercial (CV-10). In the immediate vicinity of the subject
property are various reso ,multiple-family residential and commercial uses on lands zoned
Resort (V-.75), Single F ily Residential (RS-10), Village Commercial (CV-10 and Multiple
Family Residential (RM-
County water is auailabl~ to the subject property.
Your Committee did not entertain any discussion on this measure.
Your Committee concur with the Planning Commission and the Planning Director for
recommending a favorab~e consideration for the change of zone request.
Your Committee on Pla~ing is in accord with the intent and purpose of Bill No. 311, and
recommends it pass first eading.
