HomeMy WebLinkAboutRES 546 Draft 01 1962 COUNTY OF HAWAII - STATE OF HAWAII RESOLUTION NO. 546 RESOLUTION RELATING TO THE PROPOSED WAIOHINU IMPROVEMENT DISTRICT, KAU, HAWAII, UPON AN AREA BASIS AS HERETOFORE <C-2482> PROPOSED UNDER PETITION DATED MAY 11, 1962, AND FILED WITH THE COUNTY CLERK ON MAY 14, 1962, AS AMENDED BY LETTER <C-2609> DATED JUNE 6, 1962, AND PROVIDING FOR A PUBLIC HEARING. WHEREAS, by Petition dated May 11, 1962, and filed with the County Clerk on May 14, 1962, as amended by letter dated June 6, 1962, Mark Twain Estates, Inc. has petitioned this Board for improvements consisting of new paved streets, a storm drainage system, a water system, fire hydrants, and all appurtenant and incidental work at certain land situate at Waiohinu, Kau, Hawaii, all pursuant to the provisions of Section 146-13B, Revised Laws of Hawaii 1955; and WHEREAS, in said Petition the Petitioner alleges that it is the owner of not less than sixty per cent (60%) of the entire area within the proposed improvement district; and WHEREAS, said Petition shows the necessary preliminary survey, maps, plans, drawings and other data, details and preliminary specifications for the proposed improvements, together with estimates of the probable cost thereof, and shows a description and an estimate of the share of the cost of the improvements per square foot against the property subject to assessment therefor; and WHEREAS, the said Petition has now been further and fully considered by this Board of Supervisors; NOW, THEREFORE, SE IT RESOLVED BY THE BOARD OF SUPERVISORS of the County of Hawaii as follows: Res. That the plans, descriptions, details and preliminary specifications for the proposed improvement district at Kau, Hawaii, as submitted to this Board of Supervisors by Petition of Mark Twain Estates, Inc. , dated the 11th day of May, 1962, and filed with the County Clerk on the 14th day of May, 1962, as amended by letter dated June 6, 1962, now on file and incorporated herein by reference, be and the same are hereby approved and adopted as and for the preliminary surveys, maps, plans, drawings, details and specifications for the proposed improvements, subject to such alterations and amendments as are mentioned herein or as shall hereafter be adopted according to law. II. That the proposed improvement district to be improved is shown in the maps and plans accompanying said Petition and its preliminary report. III. That it is proposed to grade and pave the streets with a 3-inch asphaltic macadam or 2-inch asphaltic concrete surfacing on a 6-inch crushed rock base course, to install a storm drainage system with galvanized corrugated sheet metal pipes and catch basin, to install a water system consisting of cast iron or cement asbestos water main of various sizes with fittings, hydrants, service lines and appurtenances in accordance with the rules and regulations of the Board of Water Supply and to construct water reservoirs with steel plates in accordance with applicable American Water Works Association specifications . -2- Res. That it is proposed that all parcels required for street rights of way, as shown on Exhibit II of said Petition and incorporated herein by reference, will be dedicated to the County of Hawaii or State of Hawaii at no cost to the County of Hawaii or State of Hawaii. V. That it is proposed that no contribution to the cost of the proposed improvements by either the County of Hawaii or the Board of Water Supply shall be required. VI. That it is estimated that the maximum total cost of all improvements, including the construction of paved streets, a storm drainage system, and the installation of a water system shall be $1,192,000; that the maximum estimated total cost of engineering, inspection, incidentals, advertising, and sale of bonds shall be $335, 100; and the maximum estimated total cost of the entire improvement district shall be $1, 527,100. VII. That it is proposed to pay for One Hundred Per Cent (100%) of the cost of the improvements by assessments made on the area basis ; that it is further proposed that all of the area within the said improvement district shall be subject to assessment, excepting the area for streets, a portion of Lots B and C, the area for commercial development (Lot F) , and remnant areas not presently being subdivided for residential lots (Lots G and H) . That it is more specifically proposed that the area to be assessed is the area of the lots to be assessed having frontage on the streets to be improved and assessed to a depth equal to the depth of residential lots, or approximately 140 feet, more or less. VIII. That the assessable area, as shown on Exhibit II attached to said Petition, is approximately 12,700,019 square feet. IX. That the proposed maximum rate of assessment per square foot on the assessable area is $0. 12024 per square foot. X. That it is proposed to permit owners to pay all of said assessment in one payment or in twenty (20) equal annual installments on principal, with interest on deferred payments at the rate of six per cent (6%) per annum. XI. That a public hearing be had respecting the proposed improvements before the Board of Supervisors, at the District Court of Kau, Naalehu, Hawaii, on the 6th day of July , 1962, at the hour of 7: 30. P .M. or as soon thereafter as those interested may be heard. XII. That the County Clerk shall give notice on behalf of the Board of Supervisors, as required by law, generally to -4- Res. No. Date: Jun 20 1962 all owners, lessees and occupants of lands proposed to be assessed, and to all other persons interested, of the general details of the proposed improvements, showing in general the character and extent of the proposed improvements, the materials proposed to be used, the probable cost of said improvements, the proposed method of assessment, the area to be assessed, the maximum cost per square foot for said improvements, all according to said preliminary plans, specifications, details and estimates submitted and filed with said Petition, as amended, together with notice that the map and general plans, details, preliminary specifications, estimates and other data submitted with said Petition with respect to the proposed improvements and herein proposed by the Board of Supervisors, may be seen and examined by any person interested at the County Clerk' s office, County Building, Hilo, Hawaii, at any time during business hours prior to and on the date fixed and advertised for said public hearing thereon, and further give notice of the time and place of said public hearing respecting the proposed improvements so that a full opportunity will then and there be given to all persons interested to present suggestions or objections to the proposed improvements, or to any part or detail thereof, said notice to be given and published in the form and manner required by law.
