Aloha,
My name is Susan Langer and I reside with my family at 18-1358 Nichols Road,
Mountain View.
Our neighborhood is a sleepy little road of mostly plantation bungalows. Many of
our neighbors have restored their homes rather than replace them. My family
lives in the old plantation field manager's house. Historical documentation
suggests our property was the site of the 1895 halfway house, a rest stop for
travelers to Volcano. We love our neighborhood and feel we should preserve the
old Hawaii charm and natural beauty of this historic Mountain View area.
Simply put, this is a residential family neighborhood; it is not the place for an
auto repair shop.
Our opposition to Bill 168 is completely supported by the Planning Director's
unfavorable recommendation dated 10/5/11.
This document states:
"...as properties along Nichols Road as well as across Highway 11 are mostly in
residential uses, it would be more prudent to retain the largely residential
character of the neighborhood along Nichols Road. This is further supported by
the GP LUPAG map which identifies the property as Low Density Urban."
"...change of zone to Village Commercial (CV-1o) would allow other commercial
uses to be established on the property...These uses allowed in a commercial
zoned district would clearly not be compatible in this largely
residential area."
"Thus, to establish the automobile repair shop in a CV zoned district, it would be
necessary to obtain a concurrent General Plan Amendment and Change of Zone.
However, the Director is not in favor of a General Plan Amendment to
accommodate the proposed use."
"Based on the above, the request for a Change of Zone...would not result in an
appropriate land use pattern and would not further the public convenience,
necessity and general welfare."
In addition to points made in the original unfavorable recommendation, the
Hawaii County Code 25-4-13, does not permit commercial auto repair shops as
home occupations. We ask how a commercial auto repair shop in the front yard
of a residence in a residential neighborhood is different from a "home
occupation"?

The General Plan considers access and public necessity. The entrance to Nichols
Road from Highway 11 is dangerous. Vehicles coming from Volcano will quickly
realize that turning onto Pszyk Road rather than from the blind curve fronting
the proposed business is safer. This will introduce commercial traffic to our
neighborhood our road cannot accommodate. Nichols Road's narrow width
currently provides something of a speed bump for children playing safely. Our
community is already well served by a large auto repair center in Kurtistown 5
miles distance from Mt. View. Our neighborhood is worth preserving for the
families who live here and as an asset to the entire community.
