Your Committee on Public Works and Parks, to which was referred Communication No. 54, and attached
Resolution No. 14-98, reports as follows:
The purpose of Resolution No. 14-98 is to grant an access easement over Parcel L-6, Tax Map Key
No. (3) 1-2-04-090, which is owned by the County of Hawaii, to Mr. James K. Ahia, III, who owns the
adjacent parcel, described as Tax Map Key Nu. (3) 1-2-4-085.
Communication No. 54 is from Gerald Takase, Deputy Corporation Counsel, dated December 16, 1998,
transmitting Resolution No. 14-98 for the Council's review and consideration. Mr. Takase states that Parcel
L-6 was created as part of a proposed County park extension under the Kaimu-Pahoa roadway project. The
County originally acquired this parcel in 1970 at which time an access easement was not reserved from Mr.
James K. Ahia.
Mr. Takase also states that Mr. Ahia's son, James K. Ahia, III, is currently trying to market the property, and
has run into a stumbling block because there is no legal access to his property, therefore, landlocking
Mc Ahia's property.
At today's meeting, Mr. James K. Ahia, III was assured by Mr. Takase that said easement runs with the land
and is transferable in the sale of the property.
Your Committee amended Resolution 14-98 in the second WHEREAS paragraph, which moves the word
"from" after the word acquired, and inserts it before the word "who"; and also amend the word "who" to
"whom".
Your Committee is in accord with the purpose and intent of Resolution No. 14-98 as amended to Draft 2, and
recommends its adoption.
