NO. 1007 <br /> <br /> PLACE: Councilroom <br /> <br /> TIME: 9:05 a.m. <br /> Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Public Works and Parks, to which was referred Communication No. <br /> 1007, reports as follows: <br /> Communication No. 1007 is from Reno Amisone, Distribution Manager, Hawaiian Buy & <br /> Sell Magazine, dated September 24, 1998, informing that their magazine is a free <br /> <br /> publication to the people of Hawaii which advertises private and commercial products <br /> statewide with a readership of 250,000 weekly. Mr. Amisone is requesting to place <br /> newsstand racks at certain locations in Hilo and Kona, which are manufactured to comply <br /> with sidewalk regulations for the Council's review and consideration. <br /> On November 17, 1998, Your Committee recommended deferral of this communication <br /> pending response from Corporation Counsel clarifying the term "abutting property owners <br /> or occupiers" as used in HCC Section 22-22(a)(4), and Mr. Amisone's submittal of written <br /> consent from property owners of proposed locations of newsstand racks. <br /> Communication No. 1007.01 is from Deputy Chief Engineer, Jiro A. Sumada, dated <br /> December 8, 1998, transmitting their comments as requested, in regards to the application <br /> from Hawaiian Buy & Sell Magazine. <br /> Communication No. 22 is from Corporation Counsel Richard D. Wurdeman, dated <br /> December 3, 1998, providing a definition of "abutting property owners or occupiers", as <br /> requested. Using the definition of abutting owner from Blacks Law Dictionary, <br /> Corporation Counsel interprets "abutting" owner as the property owner immediately <br /> fronting the newsstand, and not all owners on any block. <br /> Today Your Committee discussed concerns regarding possible obstruction of pedestrian <br /> use of the sidewalk where newsstands will be located, and that the applicant failed to <br /> comply with Section 22-22(a)(2) and (3), and Section 22-23(b) of the Hawaii County <br /> Code. <br /> <br />
