REPORT OF THE
COMMITTEE ON PUBLIC WORKS AND PARKS
DATE: March 5, 1999 RE: COMM. NO. 140 /RESOLUTION NO. 39-99
PLACE: Councilroom
TIME: 9:03 a.m.
Chair and Members
Hawaii County Council
Hilo, Hawaii 96720
Your Committee on Public Works and Parks, to which was referred Communication No. 140,
and attached Resolution No. 39-99, reports as follows:
The purpose of Resolution No. 39-99 relates to the abandonment of a homestead road in
Laupahoehoe adjacent to Tax Map Key (3) 3-6-09-031 (Laupahoehoe Police and Fire
Station).
Communication No. 140 is from Corporation Counsel Richard D. Wurdeman, dated February
1, 1999, transmitting Resolution No. 39-99 for the Council's review and consideration to
abandon a portion of a 30-foot wide road right-of--way for the construction of the
Laupahoehoe Fire Station.
Deputy Corporation Counsel Gerald Takase informed Your Committee today that this road
exists only on paper, and is therefore not in use, nor is it usable for transportation purposes for
the general public. Council Member Curtis Tyler, III expressed concern regarding the
ownership of the roadway therefore he voted kanalua twice on the measure. Mr. Takase
stated that the County owns the roadway, and that it is on the roadway inventory of the
Department of Public Works. Upon abandonment, the roadway will be placed on the Fire
Department's roadway inventory.
Your Committee is in accord with the purpose and intent of Resolution No. 39-99, and
recommends its adoption.
