Your Committee on Public Works and Pazks, to which was referred Communication No. 128, and
attached Resolution No. 34-99 reports as follows:
The purpose of Resolution No. 34-99 is to authorize the County, pursuant to section 23-10 of the
Hawaii County Code and article XIII, section 13-12 of the Hawaii County Charter, to accept a
dedication deed transmitting real property for road and drainage purposes from Sunset Ridge Joint
Venture, a Hawaii general partnership. The dedication deed is for a roadway lot located in Waikoloa,
South Kohala, Hawaii, specifically identified as Tax Map Key No: (3) 6-8-032-portion 046.
Communication No. 128 is a letter from Deputy Corporation Counsel Gerald Takase, dated January
28, 1999, which transmits Resolution No. 34-99 to the County Council for its review and
consideration. Mr. Takase states in his letter that the deed has been reviewed by the Department of
Public Works and the Planning Department and has recommended acceptance of the dedication deed.
All subdivision improvements have been completed.
Council Member J. Curtis Tyler, III voted kanalua twice with reservations because copies of the
recommendation of acceptance letters from Public Works, Planning and Water Supply departments
were not attached as part of the communications submitted from Corporation Counsel.
Your Committee is in accord with the purpose and intent of Resolution No. 34-99 and recommends its
adoption.
