Your Committee on Public Works and Pazks, to which was referred Communication No. 200,
and attached Bill No. 55, reports as follows:
The purpose of Bill No. 55 is to amend Chapter 24 (Traffic Schedule), of the Hawaii County
Code 1983 (1995 Edition), by providing a clear delineation of traffic regulations between
County streets and private streets.
Communication No. 200 is from Jiro Sumada, Deputy Chief Engineer of the Department of
Public Works, dated Mazch 12, 1999 transmitting Bill No. 55 for the Council's review and
consideration. Mr. Sumada states that in 1973, 1988, and in 1995, the State Legislature
enacted changes to the law to enable the counties to impose and enforce traffic regulations on
private streets. County Ordinance No. 95-129, which became effective on November 9, 1995,
was subsequently amended by Ordinance No. 98-97, which became effective on
September 15, 1998, to clarify the requirements for implementing the State legislation on
County of Hawaii streets.
Mr. Sumada states that this amendment will delete references to traffic regulations on private
streets that now exist in the County Code and readopt them in Article 1 Schedules for
Private Streets; thereby separating private street regulations from public street regulations.
Your Committee is in accord with the purpose and intent of Bill No. 55, and recommends that
it pass first reading.
