DEVELOPMENT(P.U.D.)
Initiates amendment to Chapter 25 (Zoning Code), article 6, division 1, relating to planned unit
development: Amends section 25-6-1 relating to Purpose; deletes section 25-6-2 relating to
Minimum land area required; amends section 25-6-3 relating to Application for P.U.D.; amends
25-6-4 relating to Notice of action on P.U.D. application; deletes section 25-6-5 relating to
Procedure for processing application when use not permitted in district; amends section 25-6-6
relating to Actions by director on P.U.D. permit applications and replaces it with Procedure for
processing P.U.D. application; adds a section 25-6-7 relating to Conditions imposed on P.U.D.,
and section 25-6-8 relating to Review and approval of final site plans; deletes section 25-6-10
relating to Criteria for granting a P.U.D. permit; replaces section 25-6-11 relating to Height
exceptions authorized with Construction in conformity with approved final site plans, and
section 25-6-12 relating to Approval of variances, use permits and plan approvals issued under
P.U.D. permit with Plan approval issued by approval of final site plans; amends section 25-6-13
relating to Effect of P.U.D. permit on other zoning provisions; amends section 25-6-14 relating
to Time extension and amendments; amends section 25-6-15 relating Appeals to Appeal of
director's actions on P.U.D. final site plans.

URGES THE 2013 HAWAII STATE LEGISLATURE TO REPEAL CHAPTER 171C OF
THE HAWAII REVISED STATUTES (HRS) TO EFFECTIVELY ABOLISH THE PUBLIC
LAND DEVELOPMENT CORPORATION
States the people of the County of Hawai`i realizes the detrimental effect that HRS 171C will
have on the land, ocean, environment, and the avoidance of many of the zoning and subdivision
laws, which HRS 17IC may ignore, and have requested assistance from the County Council to
support its repeal.

AMENDS CHAPTER 25, ARTICLE 7, DIVISION 2 OF THE HAWAII COUNTY CODE 1983
(2005 EDITION, AS AMENDED) TO INCREASE RESIDENTIAL DENSITY, INCLUDING
PARKING REQUIREMENTS, WITHIN CDH, DOWNTOWN HILO COMMERCIAL
DISTRICT
Initiates amendment to Chapter 25 (Zoning Code), article 7, division 2, section 25-7 -22, relating
to permitted use in the CDH district by reducing subsection (a)(16 and 17) maximum density of
dwelling or rentable unit from 1,000 to 500 square feet; and adds a new section to be appropriately
designated "Required number of parking spaces" for each residential dwelling having a maximum
density of 500 square feet of land area per rentable or dwelling unit within the CDH.

AMENDS ORDINANCE NO. 08 -150 WHICH AMENDED ORDINANCE NO. 465, WHICH
RECLASSIFIED LANDS FROM AGRICULTURAL — 1 ACRE (A -1A) TO NEIGHBORHOOD
COMMERCIAL — 7,500 SQUARE FEET (CN -7.5)) AT KEALAKEKUA, SOUTH KONA,
HAWAII, COVERED BY TAX MAP KEY 8 -2 -013: PORTION OF 002
Amends Ordinance No. 08 -150 by eliminating Condition E, which limits use of property to a
visitor center and related and accessory uses of a visitor center in substantial conformance to the
description in the current application for reasons of public health, safety, and welfare due to flood
hazards in the area.

From Mayor William P. Kenoi, dated August 22, 2012, submitting enclosures with a favorable
recommendation from the Leeward Planning Commission Vice Chair Lani Bowman with
inclusion of the following modification from the Planning Director: replacing the current
Condition E in its entirety by adding road improvements along the entire southeast frontage of the
property, consisting of an intersection with Mamalahoa Highway, a 20 -foot wide paved lane and
concrete curb, gutter, and sidewalk, drainage improvements, and any relocation of utilities
required by Department of Public Works (DPW), and allowing a bi- weekly farmers' limited to the
sale of local fresh or raw produce, plant life, fish, and homegrown or homemade products. Also
adding a new Condition F requiring a Traffic Impact Analysis Report should the applicants,
successors, or assigns develop a land use which generates over 50 peak hour trips; and implement
when required by DPW any transportation system improvements that may be deemed necessary.
In conclusion it recommends that Condition L regarding fair share contributions be updated to
current rates.
