CALL TO ORDER STATEMENTS FROM THE PUBLIC ON ITEM(S) ON THE AGENDA REFERRAL(S) Comm. 826: AMENDS CHAPTER 15, ARTICLE 1, SECTION 15-3, AND ARTICLE 2, SECTION (Bill 293) 15-21, OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PROHIBITION OF COMMERCIAL ACTIVITIES AT HONAUNAU BOAT RAMP Amends Chapter 15, Article 1, Section 15-3 (Definitions)and Chapter 15, Article 2, Section 15-21, by adding a new item and renumbered as required and by revising an existing item: (4) "Commercial"or"commercial activity" means a use or purpose designed for profit, which includes but is not limited to the exchange or buying and selling of commodities; the providing of services relating to or connected with trade or commerce in general; any activity performed by the commercial operator or its employees or agents in connection with the delivery of such commodities or services; and the soliciting of business. The use of the premises and facilities for official canoe club activities and races shall not be considered commercial activity.; and SECTION 3. Chapter 15, article 2, section 15-21 of the Hawaii County Code 1983 (2005 Edition, as amended), is amended to read as follows: "Section 15-21. [ ] Solicitation and commercial activity. (a) Engaging in or soliciting any business in park areas, except in accordance with the provisions of a permit, contract, or other written agreement with the County is prohibited. (b) Subsection(a)notwithstanding, commercial activity is prohibited at the following: (1) Honaunau Boat Ramp." These amendments were generated due to amend Chapter 15, relating to prohibition of commercial activities at Honaunau Boat Ramp. Intr. bv: Mr. Blas AMENDS CHAPTER 9, ARTICLE 5, DIVISION 1, SECTION 9 -33 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PLANS AND SPECIFICATIONS REQUIREMENTS Amends Chapter 9, Article 5, Division 1, Section 9 -33 (Plans and Specification requirements; deviations), subsection (b), by revising an existing item: "[All photovoltaic systems for residential and non residential installations shall require a building permit. Plans and specifications for building work shall bear the approval of an architect or structural engineer registered in the State of Hawai`i. Electrical design drawings and specifications shall bear the approval of an electrical engineer registered in the State of Hawai`i.1 Installation of photovoltaic systems shall require: (1) A building permit for residential and non residential installations; (2) Electrical design drawings and specifications bearing the approval of an electrical engineer registered in the State of Hawai`i for residential and non residential installations; and (3) Plans and specifications for building work bearing the approval of an architect or structural engineer registered in the State of Hawai`i for non residential installations onlv."
