Box 11107 Hilo, HI 96721 Dear Mr. Christensen, Re: Papaikou Beach Access We have consulted with our Na Ala Hele Trails and Access staff in Honolulu concerning this beach access. It is our opinion that this road was built by the Onomea Sugar Company for their use to access their boat landing. See attached excerpt from a report prepared by the government in 1910 regarding Private Wharves and Landings in Hawaii. We also believe that public access to the beach is a county responsibility. I commend yourself as a surveyor, former Planning Director Chris Yuen, and the community for doing the research and I hope you achieve your desired outcome. Results of your concerns: You state that the mill was built between 1895 and 1898. Examination of a sketch from a Survey Field Book Number 316 done by CJ Lyons in 1877 shows the Boiler House, Trash, Wharf and other features of the Mill that was on site in 1877. (See attached sketch) What was the trail used for and by whom before the mill was built, and especially before 1892. Examination of the same sketch mentioned above, does not show a trail. Also, based on the topography of the area, this landing probably would not have provided ideal access for canoes to transport people and material before 1892. We have the following responses to offer: 1. Does the County recognize Papa ikon Beach frail as a historically public trail? Based on our research regarding the subject parcel, we have found no evidence indicating that the Papa`ikou Mill Beach Trail is or has been a historic public trail. 2. Does the community have unrestricted right to traverse Papa`ikou Beach Trail to gain access to the beach? No. The community does not have an unrestricted right to traverse the trail as this is privately owned property. 3. & 4. Do the private landowners have the right to manage the trail and ultimately the access to the beach? Yes. The landowners have the right to manage both the trail and access on their private property, including developing and enforcing conditions of access over their private property. Generally, the State of Hawai`i has jurisdiction over the land makai of the shoreline, which is defined in HRS §205A-1 as the "upper reaches of the wash of the waves, other than storm and seismic waves, at high tide during the season of the year in which the highest wash of the waves occurs, usually evidenced by the edge of vegetation growth, or the upper limit of debris left by the wash of the waves. " The public has the right to be makai of the shoreline; however, they do not have unrestricted rights to get there across private property.
