Corp state program, Planning Committee, <br /> introducer: Ford <br /> Dear council members, <br /> I support the resolution 303-12 introduced by Brenda Ford, and thank her for <br /> her diligent efforts to help our community. <br /> The laws which create Public Lands Development Corporation, Act 55 and <br /> proposed administrative rules, remove most of the important checks and <br /> balances we, the people, have on development activities, and also prevent our <br /> County Council from having formal input into the process, especially any <br /> requirements to follow local zoning and building codes, for example. There is no <br /> requirement to hold public input sessions in any of the outer island communities <br /> as the law is written. There has been no good or believable reason given for why <br /> the public needs this PLDC -- individual projects that have been mentioned have <br /> legitimate avenues for discussion, decision making, funding, etc. The new laws <br /> are simply created to short-circuit all local, home rule of the development <br /> process. A priimary example where there is a high need for community and local <br /> government involvement is in the PLDC's "lead role" in identifying and <br /> developing geothermal energy opportunities on public trust lands. There is also <br /> considerable valid controversy about whether the State of Hawaii even has the <br /> right to develop these lands in the first place. <br /> Besides turning the State of Hawaii into a bad steward for lands held in <br /> public trust, the act also allows the executives and employees of the <br /> corporation to set whatever rate of pay they find acceptable, totally outside <br /> the constraints of civil service job classifications and pay scales. <br /> We don't need this PLDC, and we certainly do not need to be paying top <br /> dollar for bringing this corruption to the islands. I fully support Brenda Ford <br /> and the full County Council in forwarding this resolution to the state <br /> legislature of Hawaii. The Public Land Development Corporation needs to be <br /> abolished, as it is deeply flawed in its conception and execution of its actions, <br /> and is likely to cause great harm to our communities, and is likely meet many <br /> expensive legal challenges. <br /> Thank you, <br /> Lance Duncan V Lf 3. 30 <br /> Comm.
