We oppose the passage of this bill by Hawaii County. As a resident of Leilani Estates, we will
be impacted through reduced property value even though we will not be in the buffer zone
proposed and we will pay, through taxation/general fund/undetermined source for its
administration. This program cannot be self-funded other than through increased
geothermal royalties which would cancel the impetus for expansion. This draft is a _
poorly composed bill of condemnation. Y

Section 2-177 does not provide any specific location, other than near "a geothermal power
producing facility" which could cover a huge area, depending on locations of future facilities. 2
does not call for the purchase of private roads. Why should Leilani Estates pay for road upkeep
on condemned land? The County should be required to provide legal mechanisms at no
charge to homeowner associations to remove dwellings within the buffer zone from the HOA.
The County would then be solely responsible for any residents who choose to not take part in the
program.
Section 2-178 and 2-182 (the second -182) should specify a time period of ownership to prevent
speculative purchasing.
Section 2-180 (2) is a direct contradiction of previous section, claiming funding will be from
proceeds of the sale of uninhabitable properties. Which is it?
Section 2-181 (4) again refers to disposal of uninhabitable dwellings. Who would buy a
condemned dwelling at a cost sufficient to cover up to 130% of the assessed value prior to
condemnation?
We support safe geothermal facilities and believe this proposed legislation, along with Bill No.
267, are knee-jerk political reactions in an election year in response to a minority of residents.
Please put this issue before the people and let votes guide our County.
