Re:Testimony opposed to Bill 256, Draft 2, amending Chapter 2,Article 36,of the Hawaii
County Code.
The Leilani Estates Homeowners Association Board of Directors is taking this opportunity to
make clear our strong opposition to this proposed change of the Geothermal Relocation and
Community Benefits Program.The proposed changes,particularly changes detailing a one-mile
buffer zone where the County will hold purchased properties uninhabitable,will have a
decidedly negative impact for our community.It is doubtful that the County is familiar with the
Leilani Estates Charter of Incorporation which will obligate them to comply with various
responsibilities of property ownership within the subdivision.
We feel that this is an inverse condemnation action by the County of Hawaii, not taking into
account the value these properties represent to the Homeowners Association,or the value they
represent to their neighbors and the community at large.The negative impact on property
values for the entire district will be dramatic for those who are invested both financially and
emotionally in Puna.
Previously,a few residents within 3500'of the plant have been relocated due to possible health
concerns,and a few others registered complaints due to night-time noise.Quite some time ago
there were emergency releases that the plant operators controlled with little or no impact off the
plant itself.We have been unable to locate any medical or scientific data stating that the
geothermal plant operations have had an adverse health impact on its neighbors for at least six
years while we do have scientific data on new safety systems in place.To set an arbitrary one
mile radius hazard zone,with no allowance for topography,existing land use,or even actual
research,is not appropriate.To call parts of this zone`uninhabitable'when,in a few cases at
least,some people simply want to move would be a mistake.
