• <br /> •'+tY'Of k' <br /> COUNTY OF HAWAII ;• A: •; STATE OF HAWAI I <br /> . 7TH OF•Mp`I ' <br /> RESOLUTION NO. 320 12 <br /> A RESOLUTION AUTHORIZING AN EXEMPTION FROM THE STATE LAND USE <br /> DESIGNATION AND A CERTAIN REQUIREMENT OF THE COUNTY OF HAWAII <br /> ZONING CODE FOR NINETEEN HOUSING UNITS TO BE UTILIZED BY HOPE <br /> SERVICES HAWAII INC. AS LOW-INCOME SENIOR HOUSING. <br /> WHEREAS,the Hawai`i County Council (County Council) adopted Resolution 371-10 <br /> to authorize the Office of Housing and Community Development to transfer twenty-four housing <br /> units located in Kawaihae to Council District Five for use as transitional housing for low-income <br /> persons at the designated site identified by Tax Map Key No. (3) 1-5-006:017 (the Property); and <br /> WHEREAS,the County Council adopted Resolution 121-11 to exempt the Property <br /> from the Agriculture One-Acre (A-1a) zoning to allow the Property to be used as permitted by <br /> the Multi-Family Residential Two Thousand (RM-2) zoning; and <br /> WHEREAS, nineteen housing units have been relocated to the Property to provide <br /> nineteen low-income senior housing units; and <br /> WHEREAS, Hawai'i Revised Statutes (HRS), Section 201H-38, in conjunction with <br /> HRS 46-15.1, allows the County, with approval of the County Council, to exempt low-income <br /> housing projects from certain statutory requirements and a Zoning Code requirement to facilitate <br /> the development of the project; and <br /> WHEREAS, HOPE Services Hawai'i Inc. has requested that the County exempt the <br /> Property from the current State Land Use Agricultural designation to allow the nineteen housing <br /> units that are typically allowed within the State Land Use "Urban" district and to exempt the <br /> Property from a certain Zoning Code requirement; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> state land use designation from Agriculture to Urban for the Property is hereby approved. <br /> BE IT FURTHER RESOLVED that the exemption from a certain Zoning Code <br /> requirement requested for the Property, attached hereto as "Exhibit A" is hereby approved. <br /> BE IT FURTHER RESOLVED that this resolution will take effect immediately. <br />
