The Planning Commission, after a duly held public hearing on November 20, 1998, voted to
recommend for your approval the proposed legislative bill to amend Conditions C, E, F and H
of Ordinance No. 92-51, which changed the district classification from Agricultural (A-3a) to
Single Family Residential (RS-10) for approximately 10.023 acres of land. The amendment to
the conditions relates to subdivision, roadway and drainage improvements, and housing
requirements. The property is located on the east side of Kupulau Road approximately 410
feet north of its intersection with Ainaola Drive, Waiakea Homesteads, South Hilo, Hawaii.
The Commission concurs with the following Planning Director's reasons for recommending
favorable consideration of the request:
The applicants are requesting deferral of these conditions due to present
economic conditions, and have revised their original plans from developing a 32-lot to
a 3-lot subdivision on Kupulau Road in South Hilo.
The original request to change the district zoning designation for the subject
property was approved by the County Council effective May 27, 1992. The applicant
originally submitted their subdivision plans in 1992 fora 32-lot subdivision and
secured tentative subdivision approval on July 15, 1994. To minimize roadway

development within the Flood Zone "AH," revised plans were submitted fora 31-lot
subdivision in 1993. Due to economic conditions, subsequent revisions led to the
submittal of a revised plan fora 3-lot subdivision that received revised tentative
approval on July 30, 1998.
The applicant is requesting an aznendment to Condition C, which requires that
Final Subdivision Approval be secured within two yeazs from the date of receipt of
tentative subdivision approval. Revised tentative subdivision approval for the 3-lot
subdivision was secured on January 12, 1998. According to Ordinance No. 92-51, the
applicant would be required to secure Final Subdivision Approval by
July 30, 2000, which is a little over a yeaz and a half away. The applicant is
requesting an additional 5 years to secure Final Subdivision Approval.
The applicant is also requesting an amendment to Condition E, which requires
that a minimum 20-foot wide pavement with 3-foot wide shoulders be provided along
Kupulau Street to Ainaola Drive. These improvements were imposed for the
development of a 32-lot subdivision. As the applicant is proposing a 3-lot subdivision,
the applicant's request for deferral is considered as being reasonable. The requirement
to improve Kupulau Road beyond the subject property frontage to Ainaola Drive is
deleted as in all fairness, it is beyond the applicant's responsibility to make such
improvements. With present wording, the applicant would be required to widen and
resurface approximately 380 feet from the property boundazy to Ainaola Drive. As
stated in the revised wording for Condition E, the applicant shall, however, be required
to improve the entire property frontage along Kupulau Road upon any further
subdivision of the property beyond the proposed 3-lot subdivision in accordance with
the Department of Public Works requirements.
Condition F requires that the applicant shall provide drainage improvements as
may be required by, and meeting with the approval of, the Department of Public
Works. The applicant's request for deferral is also seen as reasonable as the proposed
3-lot subdivision would not require interior roadways and development that would
possibly impact drainageways. Wording in Condition F shall remain the same, as the
applicant would still be required to meet applicable drainage requirements for the 3-lot
subdivision.
Condition H requires that the applicant shall formulate a housing plan for the
development prior to securing Final Subdivision Approval. This condition shall be
amended to reflect present day wording on Affordable Housing requirements, which
would not be applicable to the proposed 3-lot subdivision since affordable housing

requirements are not applicable for less than 9 lots. Again, further subdivision may
trigger the affordable housing requirements.
Finally, according to the Department of Public Works comments, to minimize
any future impacts to Kupulau Road, they will allow only one access point onto
Kupulau Road even though there is a proposal for 3 lots. In addition, a road reserve or
subdivided right-of-way shall be provided from the new stubout at the Waiakea Heights
Subdivision to Kupulau Road. The applicant would be required to comply with these
Department of Public Works requirements, as they would fall under compliance with
Condition D.
Based on the above request, it is determined that the applicant's request is
reasonable as present economic conditions could not have been foreseen and are beyond
the control of the applicants. Granting of the amendments would also not be contrary
to the General Plan, Zoning Code or the original reasons for approving the request.
For your favorable consideration, an amendment to Ordinance No. 92-51, which reclassified
lands from Agricultural (A-3a) to Residential (RS-10) at Waiakea, South Hilo, is transmitted.

information.

WAIAKEA DEVELOPMENT VENTURES is requesting an amendment to
Conditions C, E, F and H of Ordinance No. 92-51, which changed the district classification
from Agricultural (A-3a) to Single Family Residential (RS-10) for approximately 10.023 acres
of land. The amendment to conditions relates to subdivision, roadway and drainage
improvements and housing requirements. The property is located on the east side of Kupulau
Road approximately 410 feet north of its intersection with Ainaloa Drive, Waiakea
Homesteads, South Hilo, Hawaii, TMK: 2-4-37:36 (formerly 2-4-37: Portion of 16).
BACKGROUND INFORMATION
1. Ordinance No 92-51: Effective May 27, 1992, the County Council approved the
applicant's request to reclassify a 10.023 acre portion of the subject parcel from A-3a
to an RS-10 zoned district. The applicants proposed to subdivide the property into 32-
one acre lots. (See Exhibit A -Ordinance No. 92-51)
2. Subdivision No. 6009: The applicants secured Final Subdivision Approval on March
12, 1991 to subdivide out a 3-acre portion (A-3a) of the subject property that was not
included in the approved zoning reclassification.
3. Subdivision No. 92-79: The applicants subdivision application was received by the
Planning Department on June 19, 1992 fora 32-lot subdivision with approximate lot
sizes of 10,000 square feet.
4. July 27, 1993: The applicants submitted revised preliminary maps fora 31-lot
subdivision to minimize roadway development with the Flood Zone "AH".
5. January 12, 1998: The applicants submitted revised preliminary maps fora 3-lot
subdivision. Revised tentative approval was issued by the Planning Director on
July 30, 1998. (See Exhibit B -Subdivision Map for 3 lots)

6. Request: The applicants are requesting amendments to Condition C, E, F and H of
Ordinance No. 92-51 with the reasons that present economic conditions make it
impossible to create a viable 31-lot subdivision project as originally planned. The
applicants now are proposing to subdivide the parcel into 3 lots. Based on the reduced
size of the development from the origina132-lot to a 3-lot subdivision, the applicants
are requesting additional time to secure Final Subdivision Approval (Condition C);
deferral of roadway and drainage improvements to Kupulau Road (Condition E and F);
and deferral of a housing plan for the development (Condition H).
7. Additional Information: (See Exhibit C -Letters of request dated
September 9 and 15, 1998)
DESCRIPTION OF THE PROPERTY AND iRRO IN A FA
8. Subject Property: The property is approximately 10.023 acres and has frontage on
Kupulau Road. The property is vacant and overgrown with grasses.
9. Flood Insurance Rate Map (FIRM): The subject site is within "Zone X", outside the
500 year flood plain and "Zone AH", an area of flood depths of 1-3 feet.
10. Surrounding Zoning/Land Uses: To the east is the Waiakea Heights Subdivision,
which consists of 44-10,000 square foot lots. To the west on the opposite side of
Kupulau Road are vacant parcels and single-family residential uses on lands zoned
Agricultural (A-la, A-3a and A-l0a). To the north are parcels zoned Agricultural
(A-3a) and to the south is a portion of Waiakea Homesteads, consisting of lots
averaging 7,500 square feet in size on lands zoned RS-7.5. New Hope Fellowship
(TMK: 2~-36:1) access driveway is located approximately 100 feet south of the subject
property.
UTI.IT AND •RVI
11. Access: Access to the property would be from Kupulau Road, a County road which
has a 16-foot wide pavement with 2-foot wide grass shoulders within a 30-foot right-of-
way. There is a future 50-foot road widening setback established along the west
(mauka) side of Kupulau Road. The eastern boundary of the parcel is connected to a

stubout for continuing Lelepua Street in Waiakea Heigh[s Subdivision. Original
wording in Condition E requires that the applicants provide a minimum 20-foot wide
pavement to Kupulau Road fronting the subject property and extending to Ainaola
Drive. Beyond the subject property, pavement widening would extend approximately
380 feet to Ainaola Drive.
12. Water: Water is available to the subject property.
13. All essential public utilities and services are or will be made available to support the
proposed development.

"By current rules, the subject lot is located in a Critical Wastewater Disposal Area. A
lot size of one (1) acre or more are required for the use of a cesspool. Only one (1)

BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 25-114, Article 3, Chapter 25 (Zoning
Code) of the Hawaii County Code, is amended to change the
district classification of properties described hereinafter as
follows:
The district classification of the following area
situated at Waiakea, South Hilo, Hawaii, shall be Single
Family Residential (RS-10):
Beginning at the southwest corner of this parcel of land,
being also the northwest corner of Grant 11,722 to
Mrs. Bamako Heianna and on the easterly side of Rupulau
Road, the coordinates of said point of beginning referred
to Government Survey Triangulation Station "HALM", being
18,087.84 feet South and 2,998.87 feet West, thence
running by azimuths measured clockwise from true South:

SECTION 2. This change in district classification is
conditioned upon the following: (A) the applicant, successors,
or assigns shall be responsible for complying with all of the
stated conditions of approval; (B) the applicant shall submit
the required water commitment payment to the Department of
Water Supply in accordance with its "Water Commitment
Guidelines Policy" within ninety days from the date of approval
of the Change of Zone; (C) subdivision plans shall be submitted

within one year from the effective date of the zone change.
Final Subdivision Approval shall be secured within two years
from the date of receipt of tentative subdivision approval;
(D) access to the proposed lots from Kupulau Road shall meet
with the approval of the Department of Public Works. The
proposed development's interior access roadways shall meet with
the approval of the Department of Public Works and the Fire
Department; (E) the applicant shall provide a minimum 20-foot
wide pavement with 3-foot wide shoulders within that portion of
Kupulau Road fronting the subject property to Ainaola Drive
meeting with the approval of the Department of Public Works
prior to Final Subdivision Approval or bonding to ensure that
the improvements are constructed; (F) the applicant shall
provide drainage improvements as may be required by, and
meeting with the approval of, the Department of Public Works;
(G) the method of wastewater disposal shall meet with the
approval of the appropriate government agencies; (H) to ensure
that the Goals and Policies of the Housing Element of the
General Plan are implemented, the applicant shall work with the
Office of Housing and Community Development and the Planning
Department to formulate a housing plan for the development,
which shall be consistent with the interim affordable housing
policy of the County as contained in the Hawaii County Housing
Agency Resolution No. 65. phis housing plan shall be approved
by the County Housing Agency prior to final subdivision;

provided that the applicant shall notify the County Housing
Agency of any intent to sell, lease, assign, place in trust, or
otherwise voluntarily alter the ownership interest in the
property prior to visible commencement of construction on the
property; provided further that the applicant may transfer
ownership in the property to an affiliate or in a manner
consistent with prior representations to the County Housinq
Agency; (I) restrictive covenants in the deeds of all
residential-zoned lots shall prohibit the construction of ohana
dwelling units. A copy of the proposed covenant(s) shall be
submitted to the Planning Department for review and approval
prior to final subdivision approval. Written assurance for
implementation of this condition, which has met with the
approval of the Planning Department, shall be submitted to the
Planning Department prior to final subdivision approval. A
copy of a typically recorded covenant shall be filed with the
Planning Department within one year from the date of final
subdivision approval; (J) prior to Final Plan Approval or Final
Subdivision Approval for the project, should the County
determine that additional improvements in the project area are
required (i.e. roadways, parks, police, fire etc.), the
applicant and its successors or assigns shall pay or contribute
its pro rata share of such additional improvements.
Satisfaction of this condition may be by entering into a
development agreement with the County when such a development

agreement is authorized. Any pro rata share of improvements
paid or contributed to the project area shall be credited to
any future impact fees; (R) all other applicable laws, rules,
regulations, and requirements shall be complied with;~(L) _
should the Council adopt a Unified Impact Fees ordinance
setting forth criteria for the imposition of exactions or the
assessment of impact fees, conditions included herein may, at
the applicants' election, be satisfied by performance in
accordance with the requirements of the Unified Impact Fees
Ordinance; (M) an annual progress report shall be submitted to
the Planning Director prior to the anniversary date of the
effective date of the Change of Zone. The report shall address
the status of the development and the compliance with the
conditions of approval. This condition shall remain in effect
until all of the conditions of approval have been complied with
and the Planning Director acknowledges that further reports are
not required; and (N) an extension of time for the performance
of conditions within the ordinance may be granted by the
Planning Director upon the following circumstances: 1) the
non-performance is the result of conditions that could not have
been foreseen or are beyond the control of the applicants,
successors or assigns, and that are not the result of their
fault or negligence; 2) granting of the time extension would
not be contrary to the General Plan or Zoning Code; 3) granting
of the time extension would not be contrary to the original

reasons for the granting of the Change of Zone; 4) the time
extension granted shall be for a period not to exceed the
period originally granted for performance•(i.e., a condition to
be performed within one year may be extended for up to one -
additional year); and 5) if the applicant should require an
additional extension of time, the Planning Director shall
submit the applicant's request to the County Council for
appropriate action. Further, should any of the conditions not
be met or substantially complied with in a timely fashion, the
Director shall initiate rezoning of the area to its original or
mare appropriate designation.
SECTION 3. In the event that any portion of this
ordinance is declared invalid, such invalidity shall not affect
the other parts of this ordinance.
SECTION 4. This ordinance shall take effect upon its
approval.

Dear Ms. Goldstein,
In reference to your letter dated August 17, 1998, I hereby
submit a formal letter of request to amend Change of Zone
Ordnance 92-51 (REZ 711), specifically, Conditions E, F and
H.
I am requesting for a deferral of the road widening,
(Condition E> drainage (Condition F> and housing plan
requirements (Condition H) until prior to final approval of
any subsequent proposal for further subdividing.
The present economic conditions make it virtually impossible
to create a viable 31-lot subdivision project ae originally
planned. We have, therefore, submitted for an alternate S-
lot subdivision so that parcels could be deeded to partners
separately. The expectation is that 2 of the 3 lots will
have a single family dwelling only, with one of those being

Please be informed that a water commitment for 2 additional lots effected through
the subject subdivision will expire on July 31, 2001.
Further, pursuant to Table 16 on Page 36 in Part 1 of Volume I of the Department's
Water System Standards. the zoning of the property, and Section 23-84 of the
Hawaii County Subdivision Code, fire hydrants are required to be installed. spaced
not greater than 600 feet apart and within 300 feet from the front of each lot.
Therefore. the Department cannot delete the requirement for the installation of
the fire hydrant.

We have reviewed the requested amendment and our comments are as follows:
1. We have no objections to the deferral of the road improvements (Condition E) nor
the drainage improvements (Condition F), provided that these conditions are met,
in its entirety, upon any further development.
To request athree-lot subdivision and to defer the roadway and drainage
improvements that the County Council imposed may confuse and cloud the issues
and the original iritent of the development as a whole.
2. We should condition the developers to provide a road reserve or subdivided right-
of-way that runs ftom Kupulau Road to the new stubout at the Waiakea Heights
Subdivision (f.k.a. Ainawaiwai Subdivision). We will not allow this roadway to be
constructed within any flood prone area.
3. We will allow only one access point onto Kupulau Road.
4. We will require the applicant to submit a flood study prepared by a licensed
professional civil engineer and submit this to FEMA for a Letter of Map Revision
(LOMR). Approval of this LOMR will be secured before we permit any
development.

The Office of Housing and Community Development (OHCD) hna no
objections to the proposal by Waiakea Development Partners dated

affordable housing policy, or comply with Ordinance 98-1, the
present affordable housing policy.

In reference to your letter dated August 17, 1998, I hereby
submit a formal letter of request to amend Change of Zone
Ordnance 92-51 (REZ 711), specifically, Conditions E, F and
H.
I am requesting for a deferral of the road widening,
(Condition E> drainage (Condition F> and housing plan
requirements (Condition H) until prior to final approval of
any subsequent proposal for further subdividing.
The present economic conditions make it virtually impossible
to create a viable 31-lot subdivision protect ae originally
planned. We have, therefore, submitted for an alternate S-
lot subdivision so that parcels could be deeded to partners
separately. The expectation is that 2 of the 3 lots will
have a single family dwelling only, with one of those being
accessed by the adjoining subdivision below. Until plans are
made for the approximately 5 acre parcel, there would
essentially be no additional traffic flow. We would, also,
ask the Department of Water to eliminate the Eire hydrant
requirement at this time.
