Yamamoto Request: RS -15 to RS -10 Tax Map Key: 2-4-11:87 The Planning Commission, after a duly held public hearing on November 20, 1998, voted to recommend for your approval the proposed legislative bill to change the district classification for approximately 21,780 square feet of land from Single Family Residential (RS -15) to Single Family Residential (RS -10). The property is located on the west side of Naniakea Street approximately 1,500 feet south of its intersection with Kawailani Street, Waiakea Homesteads, South Hilo, Hawaii. The Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the change of zone: In order to consider an area for any type of zoning designation, the applicable goals, policies and standards of the General Plan must be adequately addressed. Review of these goals, policies and standards in the context of the proposed request, assists us in evaluating and determining the most desirable use of land and to assure that development is coordinated within the County in the best interest of its people. It is only through a comprehensive policy analysis approach that evaluations and decisions can be made to better time or stage developments to achieve quality growth. As we look at the larger picture, we realize that the implication of these evaluations and decisions must also be considered as they may have an impact not only on other similar areas in the County, but ultimately, on the future development of the whole island. Arakaki, Chairman and Members of the County Council Page 2 The applicant is requesting the change of zone in order to subdivide the property into two (2) lots approximately 10,890 square feet in size. There is a single family dwelling on the subject property. The applicant intends to subdivide the property and construct another dwelling should the request be approved. The proposed Single -Family Residential (RS -10) zoning can conform to the following goals, policies and standards of the Land Use Element of the General Plan: * Designate and allocate land uses in appropriate proportions and mix and in keeping with the social, cultural, and physical environments of the County. * Zone urban- and rural -types of uses with ease of access to community services and employment centers and with adequate public utilities and facilities. * Zoning requests shall be reviewed with respect to General Plan designation, district goals, regional plans, State Land Use District, compatibility with adjacent zoned uses, availability of public services and utilities, access, and public need. * The county shall encourage the development and maintenance of communities meeting the needs of its residents in balance with the physical and social environment. Approval of this request would also complement the following goals and policies of the Single -Family Residential Element of the General Plan: To provide single-family residential areas conveniently located to public and private services, shopping, and other community activities and convenient access to employment centers. The County shall designate and allocate single-family residential zoned lands at varying densities for future use in accordance with the needs of the communities and the stated goals, policies, and standards. The Land Use Pattern Allocation Guide (LUPAG) Map component of the General Plan is also used to evaluate a change of zone request. This map is a graphic expression of the General Plan's goals, policies, standards and courses of action, and it displays the physical relationship among the various land uses. It also establishes the basic land use pattern that is intended to guide the direction of future development on this island. In this case, the requested zone change conforms to the LUPAG Map, Honorable James Y. Arakaki, Chairman and Members of the County Council Page 3 which designates the area for Low Density Urban Development, which allows for single-family residential developments. The applicant is requesting the change of zone designation to subdivide the property into two lots approximately 10,890 square feet in size. In addition, the Land Study Bureau's Soil Rating is Urban and the Agricultural Lands of Importance to the State of Hawaii (ALISH) Map classifies the property as Existing Urban Development. The property is in close proximity to schools, commercial areas, employment centers and public safety services. Surrounding areas are in single family dwelling uses. As such, the granting of the proposed use will not adversely affect similar or related existing uses within the surrounding area, community or region. The proposed change of zone will not unreasonably burden public agencies to provide roads and streets, sewer, water, drainage, schools, police and fire protection, and other related infrastructure. The subject property is located on Naniakea Street approximately 200 feet north of the Hilo Municipal Golf Course. It is not anticipated that the 2 -lot subdivision would have major regional impacts, however, the applicant would be required to contribute the fair share contribution. These recommendations will be included as conditions of approval. Naniakea Street has an approximate 10 -foot wide pavement. According to the Department of Public Works, a minimum 16 to 18 -foot wide pavement width is the acceptable standard for two-way vehicular traffic for a minor roadway. Because this is a 2 -lot subdivision, it would be impractical to require the applicant to provide improvements along Naniakea Street, and as such, a condition will be included to require the applicant to participate in an improvement district, should such an arrangement be initiated in the future. County water is available to the subject property. Wastewater is disposed of into an existing cesspool. However, according to the Department of Health, the subject property is located in the Critical Wastewater Disposal Area (CWDA) where cesspools are not allowed, and any subdivision on this lot would require all existing cesspools to be upgraded to a septic system. The proposed dwelling on the second lot will also require a septic system. All other essential utilities and services are or will be made available to the site. Since the subject property has already been developed and landscaped, it is not expected that archaeological features exist on the property or that it provides a habitat for endangered plants or animal species. Based on the foregoing, approval of the change of zone request from RS -15 to RS -10 would result in an appropriate land use pattern that will further the necessity, convenience and welfare of the general public. YAMAMOTO is requesting a Change of Zone by changing the district classification from Single Family Residential (RS -15) to Single Family Residential (RS -10) for approximately 21,780 square feet of land. The property is located on the west side of Naniakea Street approximately 1,500 feet south of its intersection with Kawailani Street, Waiakea Homesteads, South Hilo, Hawaii, TMK: 2-4-11:87. GENERAL INFORMATION 1. Owner: The property is owned by Amy S. Yamamoto. PROPOSED REQUEST 2. Request: The applicant is requesting the change of zone in order to subdivide the property into two (2) lots, each approximately 10,890 square feet in size. The applicant intends to subdivide to construct another dwelling on the subject property. 3. Plans Submitted: Plans show one existing single family dwelling and attached garage on the subject property. Should this request be approved, the applicant proposes to construct another dwelling to the rear of the existing dwelling. 4. Additional Information: A home occupation permit for a pest control operation was granted on May 24, 1984, but according to the applicant, the business was not established. In support of this request, the applicant has submitted a Change of Zone Application. (See Exhibit A - Change of Zone Application) STATE AND COUNTY PLANS 5. State Land Use District: Urban. 6. General Plan Goals and Polices: The proposed development would be consistent with the goals, policies, standards and courses of action of the Land Use Element. 7. General Plan LUPAG Map: Low Density Urban Development, which is single family residential in character, ancillary community and public uses, and convenience type commercial uses. ATTACH. C-25 (B-9) Hilo Community Development Plan: The plan recommends the area for RS -15 zoning. 9. County Zoning: Single Family Residential (RS -15). 10. Special Management Area (SMA): The subject property is not located within the SMA. DESCRIPTION OF PROPERTY AND SURROUNDING AREA 11. Subject Property: The subject property is a 21,780 square foot rectangular lot. The subject property is located on Naniakea Street near the dead end towards the Hilo Municipal Golf Course. There is an existing approximately 2,324 square foot 44 -year old single family dwelling and 600 square foot attached carport on the subject property. The property is landscaped. 12. ALISH: Existing Urban Development. 13. U.S.D.A. Soil Type: OID, Olaa extremely stony silty clay loam, 0 to 20 percent slopes. The surface layer is very dark brown extremely stony silty clay loam about 16 inches thick. This soil dehydrates irreversibly into gravel -size aggregates. Permeability is rapid, runoff is slow, and the erosion hazard is slight. This soil is used for sugarcane. 14. Land Study Bureau's Detailed Soil Classification System: "U" or Urban. 15. FIRM: Zone "X", outside the 500 -year flood plain. 16. Flora/Fauna and Archaeological Resources: As the subject property has been developed, the likelihood of any endangered flora and fauna or archaeological features are remote. 17. Surrounding Zoning/Land Uses: Lands adjacent to and across the street of the property are approximately 20,000 square feet in size, zoned RS -15 and in single family residential uses. The Hilo Municipal Golf Course is located approximately 200 feet to the south of the subject property, and also abuts the property to the rear. 18. Rezonings in the area: The following rezonings from RS -15 to RS -10 have been approved: A. TMK: 2-4-11:176, Ordinance No. 90 94 (REZ 666) effective 7/27/90 to Pansy Long, located approximately 2,130 feet northeast of the subject property on Kimo Place PUBLIC FACILITIES AND UTILITIES 19. Access: Access to the property is from Kawailani Street to Naniakea Street. , The subject property has frontage on Naniakea Street, a County road with an approximate 10 -foot wide pavement in fair to good condition, with grass shoulders, all within an approximate 40 -foot right-of-way. The remaining pavement leading up to Kawailani Street is approximately 12 to 16 -feet wide. According to the Department of Public Works, a minimum 16 to 18 -foot wide pavement width is the acceptable standard for two-way vehicular traffic for a minor roadway. Naniakea Street is a dead-end road with no future extension planned. 20. Water: According to the Department of Water Supply, water can be made available from an existing 6 -inch waterline along Naniakea Street fronting the subject property. 21. Sewage: According to the Department of Health, the subject property is located in the Critical Wastewater Disposal Area (CWDA) where cesspools are not allowed, and any subdivisions on this lot would require all existing cesspools to be upgraded to a septic system. Further, the proposed dwelling on the second lot will require a septic system. 22. Other Essential Utilities and Services: Electricity, telephone and cable are available to the subject property. The Kawailani Fire Station is located about 1/2 mile mauka from the site and the Central Police Station is located approximately 3 miles from the subject property. AGENCIES - COMMENTS 23. I have owned and lived on this property since 1951. It is a half acre lot and I wanted to make it into two quarter acre lots. I do not intend to sell any of the lots but to keep it in my family for future use. I have spoken with almost all of my neighbors in the surrounding area and none of them have disagreed with the rezone. Project description: Request a Change of Zone of a half acre property from Residential 15 -acre (RS -15) to Residential 10 -acre (RS -10) . b. Physical Characteristics and Environmental Setting of the Property and Surrounding Area Physical Characteristics/Environmental Setting: 8. Description of subject property, location, climate, topography, slope, soils: The subject property is located in the Waiakea Homestead House Lots, approximately 1500 ft. from the Naniakea and Kawailani intersection. The property is rectangular in shape and is relatively flat. There is an existing house on the property that was built in 1951. The climate is tropic and the soil on the property was determined to be "Old Ola'a, extremely stony, silty clay loam." 9. Lava Hazard Zone: The area is classified as Lava Hazard Zone 3. 10. Distance from coastline: The property is approximately 4 miles from the coastline. 11. Agricultural Lands of Importance in the State of Hawaii (ALISH) designation: The State Department of Agriculture's Agricultural Lands of Importance to the State of Hawaii (ALISH) Map designates the property as " Existing Urban Development. " 12. U.S.D.A. Natural Resources Conservation Service Soil Service Report soil type: The U.S. Department of Agriculture Soil Conservation Service's Soil Survey report classifies the soil on the property as "Old Ola'a, extremely stony, silty clay loam.." 13. Land Study Bureau soil rating: The Land Study Bureau's Overall Master Productivity Rating for the property is rated "Urban." 14. The subject property is cleared and exists mostly as residential lawn grass. 19. Scenic or coastal resources: None. Social -Economic Characteristics 20. Social settlement pattern for the area: The area is considered residential. 21. Economic resources in the area: This area is an old neighborhood and is specified for existing residential use. Description of access: Access to the property is from Naniakea Street (a county maintained road). The street is paved and is approximately 18 feet wide and 2000 feet in length from the Kawailani intersection. 26. Availability of water: The County Department of Water Supply states that water is available and a water meter can be installed for the new lot. 27. Sewage disposal: The existing single family residence will continue to utilize the existing cesspool for wastewater disposal. The new proposed site will need to install a septic system and leach field as stated by the State Department of Health. 28. Solid waste: Solid waste will be handled by a commercial hauler. 29. Police and Fire protection: Police and Fire service are provided in the area. 30. Schools: Waiakea Waena School, Waiakea Elementary School, Waiakea Intermediate School and Waiakea High School all exists within a mile from the subject property. 31. Parks: Ainaola Park and the Hilo Municipal Golf Course are also with a mile of the subject property. 32. Other utilities and services: Other services such as electricity and telephone are available to the property as confirmed by GTE Hawaiian Telephone Co., and Helco. E. Environmental Assessment and Analysis 33. Relationship between local short term uses of environment and maintenance and enhancement of long term productivity: The requested zoning is compatible with the surrounding area and will still provide residential opportunities. It will not impact of the area in anyway but will enhance the maximum intended use of the area. 34. Mitigative measures proposed to avoid, minimize, rectify of reduce impact: No mitigative measures are proposed since the roadways are adequate and water is available to the property. also, police and fire protection are already available in the area.
