Re: Bill No. 24 Regarding Rezoning from A-20A to A-5A at Kaloko, North Kona
Dear Ms. I.eithead•Todd and Members of the Planning Committee:
On behalf of Hao Street Hui the applicant for the subject rezoning, I would like to take this
opportunity to let you know that we have reviewed the recent bill no. 24 (draft 2) and our
substantially in agreement with the proposed conditions of the rezoning.
Our original application for rezoning was for three acre minimum lots but, after hearing the
concerns of our neighbors in the Kaloko area, we have agreed to modify out plan so that
five acre lots would be the minimum.
With this modification, the residents have come forward to support our application, and I've
enclosed a copy of the letter signed by several of them for your information.
The only condition that we'd like the Council to re-examine is condition M regarding paying
a fair share contribution for regional infrastructure impacts. We have no problem paying
our fair share for the additional lots that will be created from this rezoning. However, we
do not think we should pay for all four lots. When the project was first developed, the
original developer constructed his "fair share" of infrastructure improvements for the lot we
currently own. At some subsequent time, Ohana zoning was allowed and we now currently
have the right to have two households on this lot. It would be fair and logical if we paid
only our "fair share" for the two additional lots that this rezoning would create on our
property.

Re: Kaloko Mauka Porest Subdivision request for re-zoning (TMK:7-3-25:4)
Between Approx, 2520' to 2815' elevation - ia_t 5 ACRF RItFFPR 7Q)YE,
The County Council Resolution N. 330 % has established a policy in the Ttaloko
Mauka Watershed, paragraph 5, "Agricultural - 4 sera (A-5a) minimum tot size
densities is a narrow band immediately above the A-3a zoned district, extending to
the 2,900 foot elevation". This subject property is within the area of Critical Buffer.
As a landowner very dose by in a 21 acre property we ask you keep with this
decision and only recommend re-zoning with 5 acre lots. Also, if each parcel were 5
acres it would be entitled to the new favorable tax category of Native Forest.
We appreciate the Planning Department's recommendations, p. 4-5 for the"forest
reserve easement" buffer setbacks and no less than 50q~ retained in forestry to for
visual impacts and island watershed needs.
The Planning Department report on page 3, (10 lines fiom bottom) INCORRECTLY
suggests that the property is at the 7.500' elevation, when it is ALL above that level
in the "narrow band immediately above the A-3a zoned district, extending to the.
2,900 foot elevation"
Community input for the past several re- zonings have also led to incorperating
RESTRICTIONS TO NOT ALLOW OIiANA, to keep the density appropriate for this
Critical Watershed Area. Also, regazding this application, Police Chief Carvalho
stated in a letter of June 6, 1996, that "traffic will increase dramatically" with
increased numbers of 3 aQe lots,
Kaloko Mauka is a spedal Forest Watershed Subdivision, valuable to the
community. We are in favor of subdivision with:
Ag•5, Forest Aeserve Easements, and RESTRICTIONS TO NOT ALLOW OHANA.
