RE SOLUTION NO. 27 13
RESOLUTION ACCEPTING GRANT OF EASEMENT AND BILL OF SALE FOR
DRAINAGE SYSTEM FOR HILO HILLSIDE ESTATES, PHASE I, SITUATE AT
KUKUAU 1ST, DISTRICT OF S. HILO, ISLAND AND COUNTY OF HAWAII, STATE
OF HAWAII FROM MOANIALA HOLDINGS, LLC.
WHEREAS, Moaniala Holdings, LLC is the owner certain drainage easements, as well
as the drainage system and all appurtenances connected therewith(hereinafter"drainage
system") in, over and across the premises at Hilo Hillside Estates, Phase I and more fully
described in Exhibit A, and depicted on Exhibit B attached hereto; and
WHEREAS, Moaniala Holdings, LLC is desirous of granting the County of Hawai`i the
drainage system which is found on the premises described in Exhibit A, and depicted on
Exhibit B attached hereto; and
WHEREAS, the drainage system has been inspected and found to be in acceptable
condition and are in compliance with the provisions of Chapter 23 of the Hawai`i County Code;
and
WHEREAS, the Department of Public Works, Department of Environmental
Management, Department of Water Supply and the Planning Department have no objection to
the acceptance of this drainage system; and
WHEREAS, Section 23-10 of the Hawai`i County Code requires that the acceptance of
such drainage system be in compliance with Chapter 23 of the subdivision code; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter provides that the
Council, on behalf of the County of Hawai`i, may accept gifts or donations of money, securities
or other personal property or of real estate or any interest in real estate.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that in
accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and Chapter 23-10
of the Hawai`i County Code, the County of Hawai`i finds it is in the public interest to accept, and
hereby accepts, the grant of perpetual easement and bill of sale for the drainage system found on
the premises described in Exhibit A and depicted on Exhibit B attached hereto.
BE IT FINALLY RESOLVED that the clerk of the County of Hawai`i is directed to
transmit copies of this resolution to: (1) the Honorable William P. Kenoi, Mayor of the County
of Hawai`i; (2) the Department of Public Works; (3) the Department of Environmental
Management; (4) the Department of Water Supply; (5) the Planning Department (6) Assistant
Corporation Counsel Katherine Garson; and (7) Steven S. C. Lim, Esq., Carlsmith Ball LLP,
121 Waianuenue Avenue, Hilo, HI 96721-0686.
