Your Committee on Public Works and Parks, to which was referred Communication No.
658 and attached Resolution No. 214-00, reports as follows:
The purpose of Resolution No. 214-00, is to authorize a grant of easement over
government road to Mr. Robert C. Robertson, for waterline and sewer easements at
Kapalaalaea 2d (Beach Section), District of North Kona, Island, County and State of
Hawaii, being a portion of Tax Map Key No. (3) 7-7-10:06
and 76: vicinity of 6 and 76.
Communication No. 658 is from Finance Director Harry A. Takahashi, dated January 31,
2000, transmitting Resolution No.214-00 for the Council's review and consideration. Mr.
Takahashi states that the purpose of the easement is to construct, reconstruct, repair,
maintain and operate awater/sewer line to Mr. Robertson's residence.
Your Committee expressed concerns that this application was using a new procedure. Mr.
Takahashi stated that the procedure can be found within the Hawaii County Code under the
real property disposition section.
However, Chairman Yagong inquired about another person, Mr. Stephen Torik, who is in a
similar situation. Other residents received a permit to put in a water line, but Mr. Torik
was denied the permit, and was informed by the Department of Water Supply that a meter
cannot be issued without going through proper procedures. Chief Engineer Bob Yanabu
informed Your Committee that in the interest of helping the public, a departmental policy
change was made whereby a resident who needs a temporary permit to put in a water line
to a construction site on their property for example, may be given a 180-day permit.
However, it is not guaranteed that the permit is renewable. Chairman Yagong stated that
the Committee will be seeking clarification of the 180-day permit process as well as the
process for disposition of easement as stated in the Hawaii County Code.

Council Member J. Curtis Tyler suggested that the resolution be amended to add proper
diacritical marks to the spelling of Hawaiian words.
Your Committee is in accord with the purpose and intent of Resolution No. 214-00, as
amended to Draft 2, and recommends its adoption.
