Your Committee on Public Works and Parks and Recreation,to which was referred Res.No. 23-13,
reports as follows:
Resolution No. 23-13,transmitted by Assistant Corporation Counsel Katherine Garson via
Communication No. 33, dated December 10, 2012, accepts the dedication of road lot 9645-B-15,a
portion of tax map key: (3) 1-6-152:015 (Por), (Ulupono Center, Phase III Subdivision,Ulupono
Street) situate at Kea'au, District of Puna, Island and County of Hawai`i, State of Hawaii, from
Foster Kern, LLC.
Foster Kern, LLC is desirous of granting the roadway lot, including all subdivision improvements,to
the County of Hawai`i for roadway purposes (containing an area of 1.472 acres).
This resolution(Resolution No. 282-12, Comm.No. 791)was originally placed on the PWPRC
Committee Agenda for September 5, 2012 but was withdrawn by introducer Fred Blas at the request
of the Assistant Corporation Counsel Katherine Garson due to a typographic error in the TMK
number.
Councilmember Zendo Kern disclosed his involvement in this project as a project manager years ago.
He recused himself from voting to avoid appearance of impropriety.
Your Committee on Public Works and Parks and Recreation is in accord with the purpose and intent
of Resolution No. 23-13,and recommends its adoption.
